HomeMy WebLinkAboutReso 1968-4714a .'r FESOLUTION NO. 4714 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA, DECLARING ITS INTENTIOK' TO MAKL: ADDITIONS TO THE ACQUISITIONS AND Ii`/1PROVEMENTS Ih~ TIiAT PARKING DISTRICT KNOLVN AS "PARY.ING DISTRICT NO. 1 OF THE CITY OF CHULA VISTA" FIXING A TIME AND PLACE FOR HEARING, AND GIVING NOTICE THEREOF The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the City Council of the City of Chula Vista, on July 9, 1963, adopted and approved Ordinance No. 374, declaring that Parking District No. 1 of the City of Chula Vista was formed, and describing therein the acquisitions and improvements to be made therefor, pursuant to the provisions of the Parking District Law of 1951 (Part 4, Division 18 of the Streets and Highways Code of the State of Calif_ornia), and 6VHEREAS, the City of Chula Vista, pursuant to Section 35108.5 of the Streets and Highways Code, transferred into the Acquisition and Construction Fund the sums that were necessary to make acquisitions and improvements to be repaid from the gross or net revenues from the park- ing place or places, or from the net revenues from parking meters on same or all of the public ways in the District, or from ad valorem assessments levied upon real property in the District, and WHEREAS, t11e City Council of_ the City of Chula Vista, pur- suant to the provisions of Section 35402.3 of the Streets and Highways Code, desires to provide additional parking lots by further acquisition and improvement of_ land within said Parking District No. 1 of the City of Chula Vista. NO[~7, THEREFORE, the City Council of the City of Chula Vista, California, DOES HEREBY RESOLVE, DETERMINE, AND ORDER as follows: 1. That this City Council hereby declares its intention to add to the parking spaces in Par}ping District No. 1 of the City of Chula Vista by means of the acquisitions anc't improvements hereinafter stated, and to transfer into the Acquisition and Construction Fund such sums as may be deemed necessary, to be repaid from the gross or net revenues from the operation of the parking place or places or from the net revenues from parking meters on some or all of the public ways in the District, or from ad valorem assessments levied upon real property in the District, in the amount and f.or the purposes herein- after stated, plus interest as prescribed herein. 2. That a general description o.f the lands in said City of Chula Vista, County of San Diego, State of Ca.lif_ornia, proposed to be acquired in fee simple for use as a public parking place in Parking District No. 1 of the City of Chula Vista, is as follows: Parcel No. 568-311-1, as shown on the rolls of the County Assessor of the County of San Diego, more commonly described as 288 "F" Street, Chula Vista, California. 3. That the City Council shall declare and agree by ordinance that the city-owned land in the City of Chula Vista, County of San Diego, State of California, described as follows: Parcel No. 568-050-14, on the records of the County Assessor of the County of San Diego, more commonly described as 205 Landis, Chula Vista, California, -1- M will be transferred to the Parking District No. 1 of the City of Chula Vista, to be held, used, and. treated in all respects the same as all other parking places therein, and the cost of said parcel to the City of Chula Vista shall be repaid to the City of Chula Vista, plus interest as prescribed herein, in the same manner as advances for the acquisition of other parking places shall be repaid. 4. That a general description of the improvements as pro- posed to be made and constructed on said proposed additional parking places hereinbefore described is as follows: (a) Clearing and grading all parcels, including con- crete removal and the removal of existing buildings and other obstructions as necessary. (b) Preparing and compacting subgrade on all parcels. (c) Paving all parcels with asphaltic material, to- gether with suitable base. (d) Construction of portland cement driveways to pro- vide ingress to and egress from said parking places. (e) Removal, construction and reconstruction of side- walks, curbs and gutters on all parcels as required. (f) Construction of curb islands and wheel barriers on all parcels. (g) Painting stall lines and directional lines and arrows and installation of appropriate traffic and infor- mation signs on all parcels. (h) Installation of lighting systems on all parcels. (i) Acquisition and installation of parking meters on all parcels. (j) Any necessary work and materials appurtenant to any of the foregoing or necessary to comply with city ordinances. 5. That the estimates of the cost of the acquisitions and improvements proposed, and of the incidental expenses in connection therewith, and of the proceedings therefor, are as follows: Cost of acquisitions: Parcel No. 568-311-1, 288 "F" Street..........$95,000.00 Parcel No. 568-050-14, 205 Landis Ave.........$13,500.00 Total estimated acquisition cost .................$108,500.00 Total estimated cost of improvements described in Section 4 hereof ...............................$30,500.00 Estimated incidental expenses .....................$ 5,000.00 Total estimated costs and expenses ...............$144,000.00 6. That the estimate of the annual revenues which can expected to be derived from tl~e operation of the parking places to be added to Parking District No. 1, as described herein, and of the annual expenses of operating and maintaining said parking places, exclusive of repayment cost and interest, is as follows: -2- Total estimated annual revenues ..................$2,248.48 Total estimated annual expenses ..................$1,316.00 Estimated net annual revenues ....................$ 932.48 7. That the estimate of the annual net revenues which can be expected to be derived .from parking meters on public ways within the District and from the balance of the parking places within the District, the revenues from which are pledged to repay the advances heretofore made by the City for the acquisition of parking places within the District, and to repay the advances necessary for the acquisition and improvement of the parking places proposed to be acquired and improved, as described herein, plus interest, are as follows: Estimated annual gross revenue (actual, 1967)...$35,809.00 Estimated annual expenses (actual, 1967)........$ 8,310.00 Estimated annual net revenues (actual, 1967)....$27,499.00 8. That the total assessed value of the real property within said Parking District No. 1, as shown on the last equalized assessment roll used by the City for purposes of City taxation, to wit, the assess- ment roll of the County for the fiscal year 1966-67, as paid total assessed value is set forth is $1,950,610.00. 9. That the estimated amount of the loan proposed to be made by the City of Chula Vista to pay the costs of said proposed additional acquisitions and improvements, to pay the incidental expenses in con- nection therewith and the proceedings therefor, and for other purposes permitted by said Parking District Law of 1951 is the sum of $144,000.00; that the maximum number of years to accomplish the repayment of said loan as set fortYi herein is twenty-five (25) years from the date thereof; and the maximum rate of interest to be payable ti~ereon is the maximum rate permitted by law, to-wit, six percent (60) per annum, but the actual rate or rates shall be determined in accordance with the amount of interest that the Finance Officer of the City of Chula Vista can receive for short-range loans of City funds from year to year. 10. That the limits, as to time and rate on any ad valorem assessments which may be levied upon the taxable real property in said Parking District No. 1, for any of the purposes permitted by said Parking District Law of 1951, are, as to time, in regard to said addi- tional acquisitions, twenty-five (25) years from the date of said loan for said acquisitions and improvements, and as to rate, one dollar twenty-five cents ($1.25) on each one hundred dollars ($100.00) of assessed valuation. 11. That pursuant to Section 35270 and Section 35272 of the Streets and Highways Code, NOTICE IS IiEF.EBY GIVEN that thelbth day of April, 1968, at the hour of 7:00 p.m., in the Council Cham~,ers of this City Council in the City Hall, 276 Guava Avenue, Chula Vista, are the time and place hereby fixed for the hearing on the proposed additional acquisitions and improvements in Parkincr District No. 1 of the City of Chula Vista. Any person interested and objecting to said additional acquisitions and improvements in said Parking District, or to any other proposal in this Resolution of Intention may file a protest with the City Clerk of the City of Chula Vista. Any such protest must be in writing, must be filed not later than the date and hour fixed for hear- ing, and may be filed with said City Clerk at his office in said City Hall. f 7 r. -~ -3- 12. That the proceedings for the acquisition of said lands and the construction of said improvements are to be taken under and pursuant to said Parking District Law of 1951. 13. That pursuant to 6066 of the Government Code of the State of California, and Section 35270 of the Streets and Highways Code, the City Clerk shall cause this resolution to be published once a week for two successive weeks in the Chula Vista Star News, a newspaper of general circulation, printed and published in said City, the first publication to be at least twenty (20) days prior to the date of the hearing fixed herein. Not less than fifteen (15) days prior to the date of said hearing, the City Clerk shall mail a copy of this resolution, postage prepaid, to each person to whom real property in said district is assessed, as shown on the last equalized assessment roll of the County of San Diego, at his address as shown upon said roll, and to each person, whether owner in fee or having a lien upon, or legal or equitable interest in, any real property within said district, whose name and address and a designation of the real property in which he is interested is on file in the office of the Clerk, and shall also make such mailings as may be required by Chapter 3.5 of Title 6 of the Government Code of the State of California.
