These funds will be used for the personnel costs of one Police Sergeant, two Peace Officers and partial costs of one Police Agent. ENVIRONMENTAL REVIEW This proposed activity has been reviewed for compliance with the California Environmental Quality Act (CEQA) and it has been determined that the activity is not a "Project" as defined under Section 15378 of the State CEQA Guidelines because it will not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is necessary. RECOMMENDATION Council conduct the public hearing and adopt the resolution. BOARDS/COMMISSION RECOMMENDATION The State appropriation requires a Regional Oversight Committee's approval of the funds prior to disbursement. In accordance, the Supplemental Law Enforcement Oversight Committee (SLEOC) was established in San Diego County. The Committee is comprised of the County of San Diego Sheriff, the County of San Diego CAO, the Chula Vista Chief of Police, a regional City Manager and the District Attorney. The Committee 9-1 04/24/2012, Item Page 2 of 3 will review the City of Chula Vista's expenditure plan upon approval by the Chula Vista City Council. BACKGROUND The Police Department has been awarded $467,768 through the Supplemental Law Enforcement Services Fund (SLESF). These state funds were allocated to the Police Department for purposes required by the Citizens' Option for Public Safety (COPS) Program. Acceptance of these grant funds requires a public hearing per stipulations of the State COPS Program. During fiscal year 1996/1997, the state appropriated funds for local law enforcement services per AB 3229, Chapter 134, Statutes of 1996. In accordance with this Legislation, the state has appropriated funds annually to local law enforcement agencies. The City of Chula Vista's proportionate share of these funds is $467,768. These funds are to be deposited in the City's Supplemental Law Enforcement Services Fund (SLESF Grant Fund) and used for law enforcement personnel and equipment needs as prescribed by the original legislation (AB 3229). These funds must be used to supplement existing funds and cannot replace, or supplant, funds that have already been appropriated for the same purpose. A twenty-five percent (25%) in-kind contribution is required for these funds. The in-kind contribution will be staff time associated with procurement of equipment and training of personnel. The allocation of future funds is subject to annual state budget deliberations. DISCUSSION The Police Department will be utilizing SLESF grant monies to fund the following sworn positions: Police Sereeant During last year's budget reduction process, the entire School Resource Officer (SRO) program was slated to be eliminated (2 Sergeants, 2 Agents & 14 Officers). As a result of negotiating with the Sweetwater Unified High School District & Chula Vista Elementary School District, seven Officers in the SRO program were not eliminated and were fully funded by the school districts. To ensure adequate supervision of this important program, SLESF funding was used to fund one SRO Sergeant in fiscal year 2012. The Department recommends continued funding of the SRO Sergeant in fiscal year 2013. Peace Officers Two officer positions that were previously funded by grants (Office of Traffic Safety and California Gang Reduction, Intervention & Prevention) were funded by SLESF funding when their respective grant funding ended. In fiscal year 2012, these two positions were assigned to the Patrol Division and SLESF continued to fund their costs. The Department recommends continued SLESF funding of two Patrol officers in fiscal year 2013. 9-2 04/24/2012, Item Page 3 of 3 Police Agent Recovery Act funding for the San Diego Regional Criminal Narcotics and Border Violence Project will end on June 30, 2012. This grant funded two Police Agents assigned to the project. The Police Department is currently working with the San Diego County Sheriffs Department regazding a potential grant opportunity to fund one of the Agents over a 3-year period. The other Agent will be funded by three sources in fiscal yeaz 2013: High Intensity Drug Trafficking Areas (HIDTA), Justice Assistance Grant (JAG) and SLESF. The Department recommends to use SLESF funds for partial personnel costs of one Police Agent during fiscal yeaz 2013. DECISION MAKER CONFLICT Staff has reviewed the decision contemplated by this action and has determined that it is not site specific and consequently the 500-foot rule found in California Code of Regulations section 18704.2(a)(1) is not applicable to this decision. CURRENT YEAR FISCAL IMPACT Approval of this resolution will result in the acceptance of $467,768 from the State COPS Supplemental Law Enforcement Services Fund. These funds will be spent next fiscal year, which has no net fiscal impact in the current year. ONGOING FISCAL IMPACT A $467,768 appropriation to the personnel category of the Supplemental Law Enforcement Services Fund will be incorporated in the fiscal year 2012/2013 proposed budget and be considered as part of the normal budget process. The funding from the State COPS Program will completely offset the personnel costs, resulting in no net fiscal impact to the General Fund. The current proposal provides one yeaz funding for the positions outlined in this report. The Department will seek additional funding in subsequent fiscal years. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ACCEPTING $467,768 FROM THE STATE COPS SUPPLEMENTAL LAW ENFORCEMENT SERVICES FUND WHEREAS, during fiscal year 1996/1997, the state appropriated funds for local law enforcement services per AB 3229, Chapter 134, Statutes of 1996; and WHEREAS, the City of Chula Vista's proportionate share of the fiscal year 2012 State Cops Supplemental Law Enforcement Services Fund (SLESF) is $467,768; and and WHEREAS, a public hearing was conducted to consider the expenditure of these funds; WHEREAS, these funds will be utilized for the personnel costs of one Police Sergeant, two Peace Officers and partial costs of one Police Agent; and WHEREAS, these funds must be fully expended by June 30, 2013, otherwise any remaining funds will revert back to the State of California. NOW, THEREFORE, BE IT RESOLVED with the above findings incorporated herein, the City Council of the City of Chula Vista does hereby accept $467,768 from the State Cops Supplemental Law Enforcement Services Fund and authorize staff to incorporate said funds to the personnel category of the fiscal year 2013 proposed budget of the Supplemental Law Enforcement Services Fund.
