SUMMARY
The Otay Ranch Preserve (CFD 97-2) was specifically established to provide perpetual funding
for the maintenance and monitoring of the Otay Ranch Preserve. A reconciliation of FY 2010-11
maintenance and monitoring invoices was completed at the beginning of FY 2011-12 and a
payment in the amount of $130,000 for FY 2010-11 maintenance and monitoring invoices was
made from the FY 2011-12 Otay Ranch Preserve (CFD 97-2) maintenance and monitoring
budget. As a result, a transfer from the Otay Ranch Preserve (CFD 97-2) reserve fund in the
amount of $130,000 is required to pay to maintenance and monitoring invoices.
ENVIRONMENTAL REVIEW
The Director of Development Services has reviewed the proposed activity for compliance with
the California Environmental Quality Act (CEQA) and has determined that the activity is not a
"Project" as defined under Section 15378 of the State CEQA Guidelines because it consists of a
governmental fiscal activity that will not result in direct or indirect adverse physical changes to
the environment. Therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines the
activity is not subject to CEQA. Thus, no environmental review is necessary.
RECOMMENDATION
Council adopt the resolution.

DISCUSSION
On August 4, 2009, by Council Resolution 2009-181, the City Council approved atwo-party
agreement between the City of Chula Vista and Recon Environmental, Inc. to serve as the Otay
Ranch Preserve (CFD 97-2) steward/biologist to provide technical expertise on the status of the
Preserve, monitor the sensitive bio]ogical resources within the Preserve, and implement basic
stewardship. Staff estimated approximately $350,000 annually would cover the costs for the
Preserve stewazd/biologist to implement maintenance and monitoring of the lands. The
maintenance and monitoring budget for FY 2010-11 was $452,400 but only a total of $128,323
was paid to Recon Environmental, Inc. pending a reconciliation of FY 2010-I1 invoices. The
year-end remaining FY 2010-11 maintenance and monitoring balance was transferred to the Otay
Ranch Preserve (CFD 97-2) fund reserve. The reconciliation was completed at the beginning of
FY 2011-12 and a payment of $130,000 for FY 2010-11 invoices was made to Recon
Environmental, Ina As a result, insufficient funds are budgeted for the FY 2011-12 maintenance
and monitoring costs and a transfer from the Otay Ranch Preserve (CFD 97-2) fund reserve is
required.
DECISION MAKER CONFLICT
Staff has reviewed the property holdings of the City Council and has found no property holdings
within 500 feet of the boundazies of the property, which is the subject of this action.
CURRENT YEAR FISCAL IMPACT
Approval of the resolution will result in the appropriation of $130,000 to the Supplies and
Services expense category of Fund Otay Ranch Preserve (CFD 97-2) for prior year maintenance
and monitoring costs. There are sufficient funds in the Otay Ranch Preserve (CFD 97-2)
reserves for the proposed appropriation.
ONGOING FISCAL IMPACT
The annual cost for the maintenance and monitoring of the Otay Ranch Preserve (CFD 97-2) is
estimated at $350,000.

FACILITY DISTRICT 97-2 (CFD 97-2) BUDGET AND
APPROPRIATING $130,000 FROM CFD 97-2 RESERVES
WHEREAS, on August 4, 2009 the City of Chula Vista Council approved atwo-party
agreement between the City of Chula Vista and Recon Environmental, Inc. to serve as the Otay
Ranch Preserve steward/biologist to provide technical expertise on the status of the preserve,
monitor the sensitive biological resources within the Preserve, and implement basic stewardship;
and
WHEREAS, staff estimated approximately $350,000 annually would cover the cost for
the Preserve steward/biologist to implement maintenance and monitoring of the lands; and
WHEREAS, a reconciliation of FY 2010-I1 maintenance and monitoring invoices was
completed at the beginning of FY 2011-12 and a payment in the amount of $130,000 for FY
2010-11 invoices was made from the FY 2011-12 maintenance and monitoring budget; and
WHEREAS, insufficient funds are budgeted for the FY 2011-12 maintenance and
monitoring costs and an appropriation is required.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula
Vista amends the FY 2011-12 CFD 97-2 budget and appropriates $130,000 from the CFD 97-2
reserves.
