HomeMy WebLinkAboutReso 1969-5241' Form Noe 342' Rev 8-6"~ RESOLUTION NO ~ 5241 RESOLUTION OF THE CITY COUNCIL OF THE CITE OF' CHULA VISTA APPROVING AGREEMENT BETWEEN THE CITY OF CHULA VIS`T'A AND FREDERICK AND DOROTHY CUTCHSHAW, HUSBAND AND WIFE AND AUI'H®RT Z ING THE MAYOR TO EXECiJTE SAME The City Council of the City of Chula Vista does hereby resolve as follows: That that pertain agreement between the City of Chula Vista, a municipal co:rporati.on, and Frederick and Dorothy Cutchshaw, husband and wife, dated the 17th day of June 19 69 a copy of which is attached hereto and incorporated herein, the same as though fully set forth herein be, and the same is hereby approved, BE TT FUkTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute said agreement for and on behalf of said City._ Presented by ... ~~ Bruce H.Warren, Director of Planning ADOPTED AND APPROVED by the CITY COUNCIL of VISTA„ CALIFORNIA, this 17th day of June following vote, to-wit: Approved as to form by ~'~~ George D. ndberg, City Attorney ACES : Councilmen McAllister, Scott, Sylvester, Hamilton NAYES: Councilmen None the CITY OF CHULA 1969 by the ABSEN'T': Councilmen McCorquodale ' +~ ,` -i-'' ,~-c......~-- __.-C~ty Clerk yor/ of the City of Chula Vita pro tem STATE OF CALIFORNIA a COUNTY CF SAN DIEGO ss~ AN AGREEMENT FOR PARTICIPATION IN CERTAIN ALLEY IMPROVEMENTS ADJACENT TO PROPERTY LOCATED AT 166 FIRST AVENUE THIS AGREEMENT, made and entered into this 17th day of June , 1969, by and between THE CITY OF CHULA VISTA, a Municipal corporation, hereinafter called "City", and FREDERICK AND DOROTHY CUTCHSHAW, husband and wife, hereinafter called "Owners"; W I T N E S S E T H; WHEREAS, the Planning Commission of the City of Chula Vista on March 3, 1969 granted a variance to Frederick and Dorothy Cutchshaw, owners of certain property located at 166 First Avenue, in the City of Chula Vista, for permission to split said property into two lots, and WHEREAS, as a cond variance as contained in the Planning Commission of March to participate in the paving property at such time in the of said alley is approved by ition of the granting of said minutes of the meeting of the 3, 1969, the applicants agreed of the alley adjacent to their future as an improvement project the City of Chula Vista, and WHEREAS, applicants agreed that they would not protest in the event that a 1911 Act was instituted to accomplish said improvement, or in lieu thereof, would participate in any sort of arrangement for the construction of said improvements. NOW,, THEREFORE, IT IS AGREED by and between the parties hereto, in consideration of the premises and for other good and valuable consideration, receipt of which is hereby acknowledged, as follows: That in return for the grant of the variance by the Planning Commission on March 3, 1969, to permit the division of the property located at 166 First Avenue, owned by said applicants, into two lots, said applicants, Frederick and Dorothy Cutchshaw, their successors, heirs, assigns or transferees do hereby agree to participate in an improvement project which may be instituted and approved by the City of Chula Vista in the future for the alley adjacent to said property and further that they do hereby f '_ r.. _. agree to waive any protest to any 1911 Act which may be utilized to secure said improve- ments. IN WITNESS WHEREOF the parties hereto have caused this agreement to be executed the day and year first hereinabove set forth. THE CITY OF CHULA VISTA ~.
