RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA, APPROVING FIRST AMENDMENT TO AGREEMENT BETWEEN
THE CITY AND RICHARD GEORGE WHEELER A.I.A. AND
ASSOCIATES FOR DESIGN OF A POLICE FACILITY
The City Council of the City of Chula Vista does hereby
resolve as follows:

FIRST AMENDMENT TO AGREEMENT BETWEEN THE CITY OF CHULA
VISTA AND RICHARD GEORGE WHEELER, A.I.A. AND ASSOCIATES
FOR DESIGN OF A POLICE FACILITY EXECUTED JULY 5, 1967
THIS AMENDED AGREEMENT, made and. entered into this 17th day
of_ June 1969, b_y and. between the City of Chula Vista,
a municipal corporation, hereinafter referred to as "City"; and
Richard George Wheeler, A.I.A. and Associates, a California corporation,
hereinafter referred to as "Architect".
W I T N E S S E T H
WHEREAS, the City of Chula Vista has heretofore executed that
certain agreement dated July 5, 1967 as approved by Resolution No. 4471,
adopted by the Chula Vista City Council nn July 5, 1967, with Architect
for the construction of a police facility for the City of Chula Vista,
and
WHEREAS, by the terms of paragraph IV the following services a_re
outside the scope of the agreement:
The design and detailing of construction fence and associated
billboards, signs, etc.
The design, engineering and detailing of parking lots and
preparation of detailed landscape plans.
Interior furnishings.,
and
WHEREAS, subsequent to the execution of said agreement the
- City Council approved a master plan for the development of the Civic
Center prepared by Knight and Gladieux by Resolution No. 4929, adopted
on the 8th day of October, 1968, and
WHEREAS, in accordance with requirements of said master plan
the City entered into an agreement commissioning sad architect as
project architect for the development of the Chula Vista Civic Center
Complex, as approved by Resolution No. 5117, adopted April 1, 1969, and
WHEREAS, said agreement provided in Phase I that architect
shall develop a schematic design concept and necessary rendering fully
depicting the proposed facilities as well as a preliminary cost estimate
and construction program which cost estimate should also include any
parking areas and landscaping in conjunction with said portions of the
project. In addition the architect was specifically directed in Phase I
to develop proposed walkways, walls and. architectural designs tieing
the police facility into the existing Administrative Building, and
WHEREAS, said contract provided in paragraph IV thereof that
the design, engineering and detailing of the parking lots and preparation
of detail landscape plans are outside of the scope of the agreement, and
WHEREAS, architect has now concluded Phase I of said agreement
and is prepared to begin Phase II in conjunction with the development
of the police facility as provided in that certain agreement of July 5, 196;
and
WHEREAS, it has been determined that it is economically desireable

and feasible that architect should proceed with Phase II including
the development of the design, engineering and detailing of necessary
parking lots and preparation of detailed landscape plans as shown
on that certain schematic labled Phase I, dated June 2, 1969, Job
No. 5301 on file in the office o.f. the City Engineer, and
WHEREAS, the estimated cost accomplishing the two
parking lot projects as shown on said drawing and the covered walkway
connecting the police facility and the existing Civic Center in the
sum of $100,000.00, and
WHEREAS, paragraph VI of_ that agreement dated April
1, 1969, provides that any compensation paid for work accomplished
in Phase I would be offset against the architect's fee in the event
that the architect is awarded a contract to proceed with the work
of Phase II for anv or all of the construction projects delineated
in said contract, and
WHEREAS, architect has thus far accomplished work in
Phase I for which the City owes him $2,781.50 and it ha_s been deter-
mined that two-thirds of that amount, $1,800.00, should be credited
against the architect's fee for the schematics and cost estimates
for said two new parking lots and covered walkway connecting the
police facility and the Civic Center.
NOW, THEREFORE, IT IS MUTUALLY understood and agreed
by and between City and Architect as follows:
1. That that certain agreement dated July 5, 1967 be, and
the same is hereby amended insofar as paragraph IV thereof, services
outside a scope agreement is concerned and in no other respect, to
eliminate therefrom the design, engineering and detailing of parking
lots and preparation of detailed landscape plans.
2. That architect be, and he is hereby directed to proceed
with Phase II of said agreement insofar as the two new parking lots
and the covered walkway connecting the police facility and the Civic
Center Building as shown on that drawing labled Stage I, dated. June
2, 1969, Job No. 5301, and on file in the office of the City Engineer,
are now to be added to the basic project of the construction of the
police facility.
3. That the estimated cost of said additions to the project
is the sum of $100,000.00 and all fees for professional services in
connection therewith shall be calculated in the same manner as con-
tained in that agreement of July 5, 1967.
4. That architect is due the sum of $2,781.50 for the com-
pletion of the work of Phase I as set forth in that certain agreement
dated April 1, 1969, and of_ said sum two-thirds thereof, $1,800.00,
represents Phase I work in connection with said additions to the
project and the same shall be included in the architect's fee for
said additions to the project.
IN WITNESS WHEREOF, the parties hereto have caused this agreement
