RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA
AMENDING RESOLUTION N0. 4964 BY CHANGING THE DATE WHICH
AFFECTED PROPERTY OWNERS OF THE UNDERGROUND UTILITIES
DISTRICT MUST BE READY TO RECEIVE SERVICE AND DATE WHEN
ALL OVERHEAD FACILITIES WILL BE REMOVED
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, Resolution No. 4964 pursuant to Ordinance No. 1128
of the City of Chula Vista declared a certain underground utility
district and designated such in the City of Chula Vista in accord-
ance with Exhibit A attached thereto, and
WHEREAS, said resolution established certain dates upon which
affected property owners must be prepared to receive service and
when all overhead facilities would be removed, and
WHEREAS, it has been determined that said dates should be
changed placing said dates at a later period in time.
NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby
fix Friday, the 12th day of September, 1969, as the date on which
affected property owners must be ready to receive underground service,
and does hereby order the removal of all poles, overhead wires and
associated overhead structures and the underground installation of
wires and facilities for supplying electric, communication or similar
or associated service within said Underground Utility District on or
before the 7th day of November, 1969.
BE IT FURTHER RESOLVED that the City Clerk is hereby instructed
to notify all affected utilities and all persons owning real property
within said Underground Utility District of the adoption of this res-
olution within ten (10) days after the date of such adoption. Said
City Clerk shall further notify said property owners of the necessity
that if they or any person occupying such property desire to continue
to receive electric, communication or other similar or associated
service, they or such occupant shall, by the date fixed in this reso-
lution, provide all necessary facility changes on their premises so
as to receive such service from the lines of the supplying utility or
utilities at a new location, subject to the applicable rules, regulations
and tariffs of the respective utility or utilities on file with the
Public Utilities Commission of the State of California as of the date
of adoption of this resolution. Such notification shall be made by
mailing a copy of this resolution, together with a copy of said
Ordinance No. 1128 to affected property owners as such are shown on
the last equalized assessment roll and to the affected utilities.
