RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA
OPPOSING SB 1178 WHICH WOULD AUTHORIZE MEMBERSHIP OF LOCAL
AGENCY FORMATION COMMISSIONS FOR REPRESENTATIVES OF SPECIAL
DISTRICTS
The City Council of the City of Chula Vista does hereby resolve
as follows:
WHEREAS, the City of Chula Vista has long supported the basic
goal intented by the creation of the Local Agency Formation Commission
and set forth in the District Reorganization Act of 1965, Section 54774
of the Government Code as follows:
"Among the purposes of a local agency formation commission
are the discouragement of urban sprawl and the encourage-
ment of the orderly formation and development of local gov-
ernmental agencies based upon local conditions and circum-
stances. One of the objects of the local agency formation
commission is to make studies and to obtain and furnish in-
formation which will contribute to the logical and reasonable
development of local governments in each county and to shape
the development of local governmental agencies so as to
advantageously provide for the present and future needs of
each county and its communities."
and,
WHEREAS, the implementation of this Legislative Mandate must
necessarily include the curbing of the growth of special districts
and the ultimate elimination of those that no longer serve useful
purposes but only contend with and compete with municipalities, and
as pointed out in the state-wide survey of 1966, one of the functions
of the local agency formation commission is to deny the formation of
districts and other proposals where the need is not clearly demon-
strated, including "development promotion" districts and other pro-
posals involving dubious development schemes, and
WHEREAS, the City Council of the City of Chula Vista has
directed that certain amendments to the District Reorganization Act
be prepared which would further clarify the duties and powers of the
local agency formation commission, and
WHEREAS, one of the duties proposed is to discourage the for-
mation of special districts and promote annexation of territories
served by special districts to existing municipalities and the
assumption by the cities of the service performed by the special
districts, and
WHEREAS, the City of Chula Vista was represented three years
ago at a state-wide meeting of the local agency formation commissions
where we again went on record in opposition to the expansion of special

districts and more specifically to the representation on local agency
formation commissions of special districts, and
WHEREAS, SB 1178 would authorize membership on local agency
formation commissions, representatives of special districts; thus
introducing forces directly in opposition to the basic purposes of
the establishment of the local agency formation commission, and
WHEREAS, SB 1178 would in effect set the wolf out to guard
the sheep and pave the way for the impetuation of special districts
and stifle the vitally necessary growth of municipalities by allowing
such representatives to pass upon proposals regarding municipal
annexations or incorporations and the establishment of special districts
themselves.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Chula Vista that the City Council does hereby strongly oppose
SB 1178 and urges all members of the State Legislature to carefully
consider the disastrous effect upon the functions and goals of the
local agency formation commission should representatives of special
districts be allowed to sit in membership thereon.
BE IT FURTHER RESOLVED that the City Clerk of the City of Chula
Vista be, and he is hereby authorized and directed to forward certified
copies of this resolution to Senator James Mills, Assemblyman Wadie
Deddeh and to all members of the San Diego County Legislative Delegation
and to the legislative bodies of all municipalities in San Diego County.
