HomeMy WebLinkAboutReso 2000-400 RESOLUTION NO. 2000-400 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA CERTIFYING AND ADDING PROPERTY TO COMMLrNITY FACILITIES DISTRICT NO. 99-1 (OTAY RANCH SPA ONE - PORTIONS OF VILLAGES ONE & FIVE AND VILLAGE ONE WEST) WHEREAS, the City Council has previously formed a Community Facilities District pursuant to the provisions of the "Mello-Roos Commtmity Facilities Act of 1982," being Chapter 2.5, Part 1, Division 2, Title 5 of the Government Code of the State of Califomia (the "Act") and the City of Chula Vista Community Facilities District Ordinance enacted pursuant to the powers reserved by the City of Chula Vista under Sections 3, 5 and 7 of Article XI of the Constitution of the State of Califomia (the "Ordinance") (the Act and the Ordinance may be referred to collectively as the "Community Facilities District Law"). The existing Community Facilities District being designated as COMMUNITY FACILITIES DISTRICT NO. 99-1 (OTAY RANCH SPA ONE - PORTIONS OF VILLAGES ONE & FIVE AND VILLAGE ONE WEST) (the "District"); and WHEREAS, the City Council has also established a procedure to allow and provide for future annexations to the District and the territory proposed to be so annexed in the future was designated as COMMLrNITY FACILITIES DISTRICT NO. 99-1 (OTAY RANCH SPA ONE - PORTIONS OF VILLAGES ONE & FIVE AND VILLAGE ONE WEST), FUTURE ANNEXATION AREA (the "Future Annexation Area"); and WHEREAS, at this time the unanimous consent of the property owner or owners of certain specific territory proposed to be annexed (the "Annexed Area") has been received; and WHEREAS, a map showing the Annexed Area and designated as "Annexation Map No. 1 of Community Facilities District No. 99-1 (Otay Ranch Spa One - Portions of Villages One & Five and Village One West) of the City of Chula Vista, County of San Diego, State of California" has been submitted to the City Council. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: SECTION 1. Recitals. The above recitals are all true and correct. SECTION 2. Findings. The City Council does hereby determines as follows: A. The unanimous consent and election to the annexation of the Annexed Area to the District has been given by all of the owners of the Annexed Area and such consent and election shall be kept on file in the Office of the City Clerk. Resolution 2000-400 Page 2 B. The legislative body is authorized to levy the authorized special taxes within the Annexed Area pursuant to the rate and method of apportionment of such special tax. SECTION 3. Annexed Area. The boundaries and parcels of territory within the Annexed Area and on which special taxes will be levied is described as follows: All that property annexed to the District as said territory is shown on a map as submitted to and hereby approved by the City Council, such map designated as "Annexation Map No. 1 of Community Facilities District No. 99-1 (Otay Ranch Spa One - Portions of Villages One & Five and Village One West) of the City of Chula Vista, County of San Diego, State of California" (the "Annexation Map"), a copy of which is on file and shall remain open for public inspection. SECTION 4. Declaration Of Annexation. The City Council does hereby determine and declare that the Annexed Area is now added to and becomes a part of the District. SECTION 5. Notice. Immediately upon adoption of this Resolution, notice shall be given as follows: A. A copy of the Annexation Map as approved shall be immediately, and no later than fifteen (15) days after the date of adoption of this Resolution, filed in the Office of the County Recorder. B. An amendment to the Notice of Special Tax Lien shall be recorded in the Office of the County Recorder no later than fifteen (15) days after the date of adoption of this Resolution.
