HomeMy WebLinkAbout2012/03/27 Public CommentsTo All: This is to address the recent Resident Survey which the City of Chula Vista sent to mobile home park residents: Speaking for park residents, we are totally appalled as to the atrocious wording of the hold harmless agreement contained in the Resident Survey document. We are likewise infuriated with the back-handed way that you have treated Hispanic park residents by eliminating most of the critical legal language in the Spanish translation of the hold harmless agreement; this could be viewed as discriminatory. Additionally: 1. The first English paragraph following Code 9.50, "often referred to as rent control" is omitted in the Spanish translation. 2. Being expected to sign a legal document, AUTHORED BY THE CITY OF CHULA VISTA, which holds harmless the park owners and everybody associated with them from WILLFUL MISCONDUCT goes beyond outrageous. Who wrote this atrocity? No reasonable person with knowledge of this verbiage would sign the document as-is. Here is a legal definition of willful misconduct: Willful misconduct generally means a knowing violation of a reasonable and uniformly enforced rule or policy. It means intentionally doing that which should not be done or intentionally failing to do that which should be done, knowina that iniury to a person will probab/v result or reck/essly disreaardino the possibility that iniury to a person may result 3. The City of Chula Vista has become a party to an agreement which gives park owners license to deliberately deny eligibility to park residents who rightfully qualify, and to do so with impunity. 4. We hereby demand that the current "Resident Survey" be retracted in its entirety and reprinted and re-sent with complete and reasonable language in English and Spanish. 5. We were also informed several times the postcard would be yellow and more recognizable as an important document. 6.Once again city staff has created a problematic situation for residents and city. 7. The outreach programs being held prior to the postcard distribution, would have cured the problems that have now risen. 8. There have been reports of residents not receiving the postcards. This is happening in several parks. We are in the process of surveying other parks to see just how many residents have not actually received the "Resident Survey". At this point it appears to be wide spread through out the city. When in doubt get a copy and see if you would sign on the dotted line.
