RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA ADOPTING AN ANNEXATION MAP
SHOWING PROPERTY TO BE ANNEXED TO COMMUNITY
FACILITIES DISTRICT NO. 98-2 (INTERIM OPEN SPACE
DISTRICT [OTAY PROJECT, LLC-OVP-SPA ONE, VILLAGES
SIX AND SEVEN])
WHEREAS, the City Council desires to initiate proceedings to annex territory to an
existing Community Facilities District and to designate such annexed territory as a separate
improvement area therein pursuant to the terms and provisions of the "Mello-Roos Community
Facilities Act of 1982," being Chapter 2.5, Part I, Division 2, Title 5 of the Govemment Code of
the State of California, and specifically Article 3.5 thereof. The existing Community Facilities
District has been designated as COMMUNITY FACILITIES DISTRICT NO. 98-2 (INTERIM
OPEN SPACE DISTRICT [OTAY PROJECT, LLC-OVP-SPA ONE, VILLAGES SIX AND
SEVEN]) (the "District"); and
WHEREAS, there has been submitted a map entitled "Annexation Map No. 1 To
Community Facilities District No. 98-2 (Interim Open Space District [Otay Project, LLC-OVP-
SPA One, Villages six and seven]), City Of Chula Vista, County Of San Diego, State Of
California" (the "Annexation Map") showing the territory proposed to be annexed to the District
(the "Territory").
NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS:
SECTION 1. The above recitals are all true and correct.
SECTION 2. The Annexation Map showing the Territory proposed to be annexed to the District
and to be subject to the levy of a special tax is hereby approved and adopted.
SECTION 3. A certificate shall be endorsed on the original and on at least one (1) copy of
Annexation Map, evidencing the date and adoption of this Resolution, and within fifteen (15)
days after the adoption of the Resolution fixing the time and place of the heating on the intention
to annex or extent of the annexation to the District, a copy of such map shall be filed with the
correct and proper endorsements thereon with the County Recorder, all in the manner and form
provided for in Section 3111 of the Streets and Highways Code of the State of Califomia.
