The money was deposited by the Police Department in accordance with Government Code Article 3, Section 50050 provisions, which state that money that remains unclaimed for three years may become the property of the City after certain advertising requirements are met. The amount of $18,561 is now eligible for transfer to the General Fund. ENVIRONMENTAL REVIEW This proposed activity has been reviewed for compliance with the California Environmental Quality Act (CEQA) and it has been determined that the activity is not a "Project" as defined under Section 15378 of the State CEQA Guidelines because it will not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is necessary. RECOMMENDATION Council adopt the resolution. BOARDS/COMMISSION RECOMMENDATION Not Applicable. DISCUSSION The City currently has unclaimed monies in the Cash Bond Deposit Fund. Monies deposited into the Cash Bond Deposit Fund primarily include cash confiscated during arrests that has remained unclaimed. This money was deposited by the Police 4-1 4/3/2012, Item Page 2 of 2 Department in accordance with Article 3, Section 50050 of the Govenunent Code. According to Government Code provisions, money that remains unclaimed for three years may become the property of the City after certain advertising requirements are met. Government Code Section 50052 provides that if no claim is made for the monies after proper notification as required by Government Code section 50050, the unclaimed money may become the property of the City on a designated date not less than 45 days nor more than 60 days after the first publication of the notice. The City gave public notice of the unclaimed monies in the Star News on February 17 and 24, 2012. The amount of $18,561 is now eligible for transfer to the General Fund. DECISION MAKER CONFLICT Staff has reviewed the decision contemplated by this action and has determined that it is not site specific and consequently the 500-foot rule found in California Code of Regulations section 18704.2(a)(1) is not applicable to this decision. CURRENT YEAR FISCAL IMPACT Approval of this resolution will result in the transfer of $18,561 to the General Fund. This transfer is already included in the fiscal year 2011/2012 budget. Therefore, there is no net fiscal impact to the General Fund. ONGOING FISCAL IMPACT There is no ongoing fiscal impact for this transfer.
