This system is maintained by the State Department of Justice, but the County of San Diego is the responsible agency for system allocation and funding. The County RAN Board extended user fee contracts through June 30, 2013. ENVIRONMENTAL REVIEW This proposed activity has been reviewed for compliance with the California Environmental Quality Act (CEQA) and it has been determined that the activity is not a "Project" as defined under Section 15378 of the State CEQA Guidelines because it will not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is necessary. RECOMMENDATION Council adopt the resolution. BOARDS/COMMISSION RECOMMENDATION Not Applicable. DISCUSSION 3-1 4/3/2012, Item 3 Page 2 of 2 The State of California Department of Justice maintains an automated system for retaining and identifying fingerprints, palm prints and photos called the California Identification System and Cal-Photo (hereinafter referred to as "Cal-ID"). The California Penal Code, Section 1112.1 provides for the establishment of a Remote Access Network (RAN), consisting of a statewide network of equipment and procedures allowing local law enforcement agencies direct access to Cal-ID. The San Diego County Sheriff s Department is the County's proprietazy agency for San Diego County's Cal-ID/RAN. Since 1990, the Police Department has been entering into five-year agreements with the County of San Diego to participate in Cal-ID/RAN. The current agreement terminated on June 30, 2010, and the County RAN Boazd extended the user fee contracts through June 30, 2013. The Police Department is requesting continued participation of the Cal- ID/Remote Access Network through June 30, 2013. DECISION MAKER CONFLICT Staff has reviewed the decision contemplated by this action and has determined that it is not site specific and consequently the 500-foot rule found in California Code of Regulations section 18704.2(a)(1) is not applicable to this decision. CURRENT YEAR FISCAL IMPACT Approval of this resolution will result in the Police Department's continued participation of the Cal-ID/Remote Access Network through June 30, 2013. The City will reimburse the County for its proportional shaze of net operational costs associated with Cal-ID/RAN based on the city's percentage of total county population and the city's percentage of FBI crimes. These associated costs, approximately $53,000 annually, are already included in the Police Department budget. Therefore, there is no net fiscal impact to the General Fund. ONGOING FISCAL IMPACT A $53,000 appropriation for Cal-ID/RAN costs will be incorporated in the fiscal year 2012/2013 proposed budget and be considered as part of the normal budget process. No net fiscal impact results from this action. The user agreement has been extended by the RAN Board, most recently on February 17, 2012. The RAN Board extended the user fee contracts through June 30, 2013. NOW, THEREFORE, BE IT RESOLVED the City Council of the City of Chula Vista does hereby approve the agreement extension with the County of San Diego for the Police Department's participation in the California Identification System Remote Access Network.
