All projects that the City of Chula Vista proposes to fund with Transnet funds must be included in the RTIP, as well as projects that are funded with Federal or State transportation funds. ENVIRONMENTAL REVIEW The Director of Development Services has reviewed the proposed activity, consisting of approval to submit a funding request for various Transnet Projects to SANDAG, for compliance with the California Environmental Quality Act (CEQA) and has determined that the activity is not a "Project" as defined under Section 15378 of the State CEQA Guidelines. Therefore, pursuant to Section 15060 (c)(3) of the State CEQA Guidelines the activity is not subject to CEQA. Thus, no environmental review is necessary at this time. Although environmental review is not necessary at this time, once the scope of the individual projects proposed to be funded have been more specifically defined, environmental review will be required for each project and the appropriate environmental determination will be made. 6-1 3/27/12, Item ~O Page 2 of 7 RECOMMENDATION Council conduct the public hearing and adopt the resolution. BOARDS/COMMISSION RECOMMENDATION Not applicable. DISCUSSION Transnet History and Regulations The voters of San Diego County approved the Transnet Program as Proposition A in November 1987. This proposition enacted ahalf--cent increase in the countywide sales tax through 2008 to fund specified transportation programs and projects. One third of the revenues generated by the tax were allocated by SANDAG to the local agencies for local streets and roads purposes. These funds have been distributed to cities annually and programmed by cities into local projects. In November 2004, 67 percent of County voters supported Proposition A, which extends Transnet from 2008 to 2048. The Transnet Extension Ordinance states that at least 70 percent of the funds allocated to local agencies for local road projects should be used to fund construction of new or expanded facilities, major rehabilitation and reconstruction of roadways, traffic signalization, transportation infrastructure to support smart growth, capital improvements for transit facilities, and operating support for local shuttle and circulator transit routes (Congestion Relief). No more than 30 percent of Transnet funds allocated to local agencies for local road projects are expected to be used for local street and road maintenance. The SANDAG Board has subsequently adopted guidelines implementing this policy (Attachment 1). The Maintenance and Non-Congestion Relief category includes maintenance activities such as pothole repair, seals, traffic signal and lamp replacement, roadway signing and striping, minor drainage improvements and overlays less than one-inch thick. The Congestion Relief category includes roadway and bridge widening, pavement reconstruction and overlays one-inch thick or greater, new sidewalks and roadway drainage improvements for the purpose of reducing significant and frequent roadway flooding. This category also includes various traffic operations improvements, such as traffic signal coordination and interconnection, traffic signal upgrades, video surveillance and data collection for performance monitoring purposes. Certain improvements, such as traffic calming measures, pedestrian ramps, street buffer areas (such as landscaped strips), bus stop enhancements and pedestrian traffic signals, are included in the 70 percent category if they are in SANDAG-designated Smart Growth areas. Projects included under the Congestion Relief portion of Transnet aze required to accommodate travel by pedestrians and bicyclists in accordance with the Transnet Ordinance and Rule 20 of SANDAG Board Policy 31, "Accommodation of Bicyclists and Pedestrians". This rule states that evaluating bicycle and pedestrian accommodation is required for all major reconstruction projects included under Congestion Relief under the 70-30 requirement. Cities may use a bicycle or pedestrian master plan adopted by the city council and approved by SANDAG within the last five years to determine the appropriate means of accommodating bicyclists and pedestrians in a given project. Since Chula Vista's Bikeway Master Plan Update was adopted by 6-2 3/27/12, Item ~i Page 3 of 7 the City Council on February I, 2011 and the Pedestrian Master Plan was adopted on June 22, 2010, they qualify under this provision. The 2010 RTIP was last amended by Council on February 28, 2012 by Resolution 2012-030 (Attachment 2). The purpose of this amendment was to enact four minor changes to the 2010 RTIP that would take effect as soon as possible. This included the addition of new locations to CHV48 (Major Pavement Rehabilitation) and CHV50 (Emergency Storm Drain Repair) and a refund to SANDAG of $16,175 in TransNet Bicycle funds that had been allocated to an ineligible project. Additionally, the description under CHV39 (Traffic Signal Systems Optimization) was amended in order to include payment for the Regional Arterial Management System (RAMS). Proposed 2012 RTIP SANDAG's letter dated January 27, 2012 provided the schedule for the 2012 RTIP. Agencies are required to submit their proposed projects to SANDAG for inclusion in the 2012 Regional Transportation Improvement Program (RTIP) by April 6, 2012. The 2012 RTIP will cover five fiscal years from Fiscal Year 2012-13 through Fiscal Year 2016-17. The SANDAG Boazd of Directors is scheduled to adopt the final 2012 RTIP on September 28, 2012, with Federal adoption predicted to occur in mid-December, 2012. Chula Vista's share of the FY2013 allocation is estimated to be $4,700,000, with a total estimated revenue of $26,152,000 for the five yeazs ending with FY2017. This is an increase of approximately $2.9 million over the last five year estimate prepared by SANDAG in February 2011. Additionally, the new Chula Vista estimate of $4,497,000 for FY2012 is $150,000 over the original estimate. This amount has been added to the FY2013 amount, for a combined total of $3,395,000 for Congestion Relief (CR) projects and $1,455,000 for Maintenance (M). Chula Vista's proposed allocation for the 2012 RTIP is shown on the table, TransNet Allocations FY 2013 through FY 2017 (Attachment 3). These projects will be incorporated into the Fiscal Year 2012-13 Capital Improvement Program (CIP). The following new projects are proposed to be added to the 2012 RTIP 1. Safe Routes to School FundinE Match On March 13, 2012, Council approved the submittal of a grant application from the State Safe Routes to School (SR2S) for funding of pedestrian safety improvements in the vicinity of Castle Park Middle School ($798,900) and Hazel Goes Cook Elementary School ($434,200) (Attachment 4). These projects would include the construction of missing sidewalk along Quintard Street, bulb-outs and raised medians, crosswalks and pedestrian ramps, traffic signal modifications and safety educational activities at the schools. If these grants aze approved, a total of $398,600 in matching funds will be needed, including $349,100 for Castle Pazk and $49,500 for Hazel Goes Cook. These funds will be allocated to RTIP Project CHV33 School Zone Traffic Calming. 2. Alpine Avenue Sidewalks (CHV581 As part of the Castle Park Improvement Program, curb, gutter and sidewalks and street improvements have been constructed along various streets in the Castle Park section of 6-3 3/27/12, Item Page 4 of 7 the Montgomery area. Property owners have contributed a portion of the cost through the formation of assessment districts. One of the last districts to be established is on Alpine Avenue between Emerson Street and Oxford Street. Since funds from the Section 108 loan used to finance this program are running out, it is requested that $300,000 be allocated from TransNet. Section 108 funds will be used first. 3. Industrial Blvd./ Anita Street Intersection Improvements (CHV60) SANDAG will be widening the rail crossing at Anita Street east of Industrial Blvd. Due to this construction, the City will need to widen Industrial Blvd. along the west side to approximately 100 feet north of Anita Street and relocate the existing traffic signal. Associated work to be funded by the City includes construction of bike lanes, traffic signal upgrade, pedestrian improvements on the west side and drainage work needed to construct the additional roadway. All work will be within existing City right-of--way. It is projected that construction will take place in Fiscal Year 2013-14. $200,000 will be allocated to this project from TransNet in Fiscal Year 2013-14. 4. Heritage Road (CHV-NEW) In order to serve new development in southeast Chula Vista, Heritage Road will need to be extended from Main Street north to Olympic Blvd (STM374). This project was included in the 2005 Transportation Development Impact Fee revision. Anew six-lane prime arterial is needed, with an estimated cost of $20,649,250. This project needs to be included in the RTIP; however, no TransNet funds will currently be added. $150,000 in TDIF funds will be included in the project for Fiscal Year 2012-13. Additionally, the following are the major ongoing projects that are proposed to receive additional funding allocations through this amendment: Traffic Engineering Programs: These projects relate to several ongoing City programs related to maintaining compliance with City threshold standards, traffic monitoring and safety improvements. Proposed Transnet funding and CIP projects include the following: a. CHV45 -Traffic Monitoring (STL274, TF321, TF325): $70,000 per year b. CHV43 -Congestion Relief (TF354): $30,000 in FY13, estimated $75,000 per year subsequently. c. CHV35 - Traffic Signing and Striping (TF332) (STM369), Studies and Signal/Streetlight Upgrade (TF366): $140,000 in FY13, estimated $150,000 per year subsequently. d. CHV33 -Traffic Calming Program (TF345): $50,000 per year beginning in FY14. e. CHV34 -Neighborhood Traffic and Pedestrian Safety Program (TF327): $20,000 in FY13; $50,000 in subsequent years. £ CHV39 -Traffic Signal System Optimization (TF350): $100,000 per year. 2. Traffic Signals (CHV601: Traffic signals will be installed at the two intersections of Industrial Blvd./ Moss Street and at Industrial Blvd./ Naples Street as a joint project with SANDAG due to requirements from the California Public Utilities Commission (CPUC) on upgrades that SANDAG would like to make to the rail crossings. The City's share of 6-4 3/27/12, Item~_ Page 5 of 7 this funding is $250,000, but it will not be needed until Fiscal. Year 2013-14. An additional $250,000 will be allocated for traffic signal modifications at Third Avenue and Naples Street. 3. Pavement Maior Rehabilitation (CHV48): This includes the portion of the Pavement Rehabilitation Program that includes overlays (one-inch and greater) and reconstruction. Compliance with the American with Disabilities Act (ADA) is required. The City has revised this street list (Attachment 5), previously included as a part of the 2010 RTIP Amendment approved by Council in March 201 I. This list will be used for the Transnet- funded Pavement Major Rehabilitation program. A total of $2,665,000 in TransNet funds should be available in FY13. Subsequent years' allocations are estimated. 4. Other Existin¢ Proiects: The following are other existing projects that have proposed allocations: a. CHV22 -Advance Planning Studies (OP202): $47,000 to $57,000 from FY13 to FY17 b. CHV50 -Emergency Storm Drain Repair: The allocation is proposed to be $850,000 in Fiscal Yeaz 2012-13, with $600,000 from current funds and $250,000 from reallocated funds (see below). These funds will be used for rehabilitation of deteriorated and failed Corrugated Metal Pipe (CMP) that are used to transport storm water from public roadways. This list has been expanded to include additional priority projects (Attachment 6). c. CHV06 -Pavement Management System (OP219): An additional $150,000 will be allocated to expand the City's pavement management efforts, including additional inspection and analysis. Reallocation of Existing Funds TransNet funds in the amount of $535,873 need to be reallocated to new and existing projects from several completed projects. These projects include the following: CHV 19 -North Broadway Reconstruction (STM354): $526,441 CHV42 -Major Intersection Safety (TF353): $6,498 CHV55 -Castle Park Improvements (STL342 only): $2,934 (reimbursement from Sweetwater Authority) Since the funds from CHV 19 and CHV42 are from Old TransNet funds (prior to Fiscal Year 2008-09), there are no restrictions on their allocation to any TransNet-eligible project. The funds from CHV55 were originally from the Congestion Relief portion of the TransNet allocation, so they need to be used on a Congestion Relief project. These funds will be used as follows: • CHV 18 -Fourth Avenue Sidewalk Improvements (STL291): $25,000 (Congestion Relief) • CHV33 -Enhanced Traffic Calming Crosswalk Improvements at the Vicinity of Montgomery Elementary School (STL375): $80,000 (Congestion Relief) • CHV08 -Willow Street Bridge (Traffic Signal Design): $75,000 (Congestion Relief) 6-5 3/27/12, Item Page 6 of 7 • CHV59 -Sidewalk Installation along Naples Street (STL365): $90,000 (Congestion Relief) • CHV50 -Emergency Storm Drain Repair: $250,000 (Maintenance) • CHV22-CIP Management (OP208): $15,873 (Maintenance) Staff has evaluated all the projects for compliance with the bicycle and pedestrian regulations. Some of the streets included in the list for CHV48 were already reviewed for compliance for the 2010 RTIP amendments, so they do not need to be reconsidered. The inclusion of new sidewalks along Alpine Avenue will improve the current pedestrian accommodations. All projects are in compliance with the City's 2011 Bikeway Master Plan. There is only one project that will need a pedestrian exclusion, and that is the Anita Street/ Industrial Blvd. Improvements. Bikeways will be provided on Industrial Blvd. along the project route, and sidewalks will be provided on the west side of Industrial Blvd. The only pedestrian exclusion will be along the east side of Industrial Blvd. The City is asking for an exclusion for the following reasons: • The City will not be extending the roadway width along the east side of Industrial Blvd. • The City is constructing the project as a result of an adjacent project constructed by SANDAG. • It would be more effective to provide a sidewalk that will extend from Anita Street to the next intersection, not just from Anita Street to 100 feet to the north. Such a sidewalk would be a "sidewalk to nowhere" and would not provide any additional access. The TransNet Extension Ordinance also requires per the Regional Transportation Congestion Improvement Program (RTCIP) that the City collect from the private sector a minimum of $2000 per new residential unit (EDU), effective July 1, 2008, with annual escalation of not less than 2 percent based on the ENR (or similar) Construction Cost Index. These exactions are to pay for the proportional share of funding to improve the Regional Arterial System (RAS). The minimum amount for the RAS is $2123 for Fiscal Year 2011-12 and will increase by 2 percent to $2165 for Fiscal Year 2012-13. Low to moderate income housing units are exempt. The City's Transportation Development Impact Fee has been in place since 1988 for the area of the City east of I-805. On March 18, 2008 Council enacted the Western Chula Vista Transportation . Development Impact Fee (WTDIF) at the rate of $3243 per EDU. The City is in compliance with these requirements. The WTDIF began to be collected as of May 19, 2008. The TDIF also complies, even though it was enacted before the new TransNet legislation was adopted. DECISION MAKER CONFLICT For On¢oing Projects #3 and #4b: Pursuant to California Code of Regulations Section 18704.2 (b)(2), there is no material effect on any economic interests in real property as the "decision solely concerns repairs, replacement, or maintenance of existing streets, water, sewer, storm drainage or similar facilities." For Fourth Avenue Sidewalk Improvements: Staff has reviewed the decision contemplated by this action and has found that a conflict exists, in that Councilmember Ramirez has property holdings within 500 feet of the property which is the subject of this action. 6-6 3/27/12, Item Page 7 of 7 For All Other Projects: Staff has reviewed the property holdings of the City Council and has found no property holdings within 500 feet of the boundaries of the properties which are the subject of this action. CURRENT YEAR FISCAL IMPACT These actions will have no impact on the General Fund. However, approval of this resolution will result in an allocation of $4,850,000 in TransNet funds during Fiscal Year 2012-13 and a reallocation of $535,873 in existing TransNet funds. These allocations will be included in the Fiscal Year 2012-13 Capital Improvement Program. ONGOING FISCAL IMPACT None. ATTACHMENTS 1. Accommodation of Bicyclists and Pedestrians 2. J:\Engineer\AGENDA\CAS2012\03-27-12\RTIP 2012FINAL.doc 6-~ Attachment 1 TransNet Local Street and Road Program TransNet Ordinance and Expenditure Plan Implementation Guidelines June 23, 2006 The TransNet Ordinance requires that at least 70 percent of the revenues provided for local street and road purposes should be used to fund direct expenditures for facilities contributing to congestion relief. No more than 30 percent of these funds should be used for local street and road maintenance purposes. The required multi-year Regional Transportation Improvement Program (RTIP) project lists submitted by local agencies that are found to be out of compliance with this requirement will not be approved. Local agencies may request an exception to this requirement and must providejustification for such a request as part of its project list submittal. The following table categorizes and lists the more typical types of facilities that are considered to contribute to congestion relief. For other facilities not listed, it must be demonstrated that congestion relief can be obtained before the project can be considered part of the 70 percent Congestion Relief category. Maintenance costs of items listed in the 70 percent Congestion Relief category are eligible under the 30 percent category. Smart growth-related infrastructure built outside of one of the seven types of characteristic areas is eligible under the 30 percent category. 4 6-9 AT7A~'`~MEIJT ~ RESOLUTION NO.2012-030 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ADOPTING THE TRANSNET LOCAL STREET IMPROVEMENT PROGRAM OF PROJECTS FOR FISCAL YEARS 2010/2011 THROUGH 2014/2015, PROVIDING THE CERTIFICATION AND INDEMNITY STATEMENTS NECESSARY TO OBTAIN TRANSNET FUNDS, AND APPROPRIATING $16,175 AND RELATED INTEREST IN THE TRANSNET FUND WHEREAS, on November 4, 2004, the voters of San Diego County approved the San Diego Transportation Improvement Program Ordinance and Expenditure Plan (TransNet Extension Ordinance); and WHEREAS, the TransNet Extension Ordinance provides that SANDAG, acting as the Regional Transportation Commission, shall approve amulti-yeaz program of projects submitted by local jurisdictions identifying those transportation projects eligible to use transportation sales tax (TransNet) funds; and WHEREAS, the City of Chula Vista was provided with an estimate of annual TransNet local street improvement revenues for Fiscal Years 2013 through 2017; and WHEREAS, staff recommends amending the Regional Transportation Improvement Program (RTIP) as follows: 1. Add the segment of Brandywine Avenue from Point La Jolla to Mendocino Drive in project CHV48; and 2. Amend Transnet project CHV39, Traffic. Signal Systems Optimization, to include the Regional Arterial Management System (RAMS). 3. Amend CHV50, Emergency Storm Drain Repair, to add F Street east of Woodlawn Avenue, due to failure of existing corrugated metal pipe, and other urgent locations needed to maintain safe travel conditions. WHEREAS, $16,175 in Transnet Bicycle funds were transferred to an ineligible project, STM361, I-5 Multi-modal Corridor Analysis, and must be returned to SANDAG with all related interest. An appropriation to the expense category of the Transnet fund of $16,175 and related interest will be necessary to accomplish this; and WHEREAS, the City of Chula Vista has held a noticed public meeting with an agenda item that cleazly identified the proposed list of projects prior to approval of the projects by its authorized legislative body in accordance with Section 5(A) of the TransNet Extension Ordinance and Rule 7 of SANDAG Board Policy No. 3 L 6-10 Resolution No. 2012-030 Page 2 NOW, THEREFORE, BE IT RESOLVED that pursuant to Section 2(C)(1) of the TransNet Extension Ordinance, the City of Chula Vista certifies that no more than 30 percent of its annual revenues shall be spent on maintenance-related projects. BE IT FURTHER RESOLVED that pursuant to Section 4(E)(3) of the TransNet Extension Ordinance, the City of Chula Vista certifies that all new projects, or major reconstruction projects, funded by TransNet revenues shall accommodate travel by pedestrians and bicyclists, and that any exception to this requirement permitted under the Ordinance and proposed shall be cleazly noticed as part of the City of Chula Vista's public hearing process. BE IT FURTHER RESOLVED that pursuant to Section 8 of the TransNet Extension Ordinance, the City of Chula Vista certifies that the required minimum annual level of local discretionary fends to be expended for street and road purposes will be met throughout the 5- yeaz period consistent with the most recent Maintenance of Effort Requirements adopted by SANDAG. BE IT FURTHER RESOLVED that pursuant to Section 9A of the TransNet Extension Ordinance, the City of Chula Vista certifies that it will extract $2,000, plus all applicable annual increases, from the private sector for each newly constructed residential housing unit in that jurisdiction to comply with the provisions of the Regional Transportation Congestion Improvement Program (RTCIP). BE IT FURTHER RESOLVED that pursuant to Section 13 of the TransNet Extension Ordinance, the Ciry of Chula Vista certifies that it has established a sepazate Transportation Improvement Account for TransNet revenues with interest earned expended only for those purposes for which the funds were allocated. BE IT FURTHER RESOLVED that pursuant to Section 18 of the TransNet Extension Ordinance, the City of Chula Vista certifies that each project of $250,000 or more will be cleazly designated during construction with TransNet project funding identification signs. BE IT FURTHER RESOLVED that the City of Chula Vista does hereby certify that all other applicable provisions of the TransNet Extension Ordinance and SANDAG Boazd Policy No. 31 have been met. BE IT FURTHER RESOLVED that the City Council of the City of Chula Vista adopts the Transnet Local Street Improvement Program of Projects for Fiscal Years 2011/2012 through 2014/2015 and amends it as follows: 1. Adds the segment of Brandywine Avenue from Point La Jolla to Mendocino Drive in project CHV48; and 6-11 Resolution No. 2012-030 Page 3 2. Adds Regional Arterial Management System (RAMS) to Transnet project CHV39, Traffic Signal Systems Optimization; and 3. Adds emergency repairs to storm drains at F Street east of Woodlawn Avenue, due to failure of existing corrugated metal pipe, and other urgent locations needed to maintain safe travel conditions to CHV50, Emergency Storm Drain Repair; and BE IT FURTHER RESOLVED that the City Council of the City Of Chula Vista appropriates $16,175 in Transnet Bicycle funds that were transferred to an ineligible project, STM361, I-5 Multi-modal Corridor Analysis, including all related interest to the expense category of the Transnet fund to return to SANDAG. WHEREAS, California legislated a Safe Routes to School (SR2S) program in 1999 with the enactment of AB 1475; and WHEREAS, the goals of the SR2S program are to reduce injuries and fatalities through the construction of capital projects that improve safety for children in grades K-12 who walls or bicycle to school and. to encourage increased walking and bicycling to school; and WHEREAS, Section 2333.5 of the Streets and Highways Code calls for the Department of Transportation, in consultation with the California Highway Patrol (CHP), to make grants available to local governmental agencies under the program based upon the results of a statewide competition; and WHEREAS, a Call for Projects has been announced for Cycle 10 which would be funded from the 2011/12 State Budget Act and the projected funding from the 2012113 State Budget; and WHEREAS, the deadline for submitting applications is Mazch 30, 2012; and WHEREAS, staff recommends the submittal of the following two applications for SR2S funding: • Quintazd Street Corridor Pedestrian Safety Improvements from Third Avenue to Hilltop Drive. These projects include: CHV19 -North Broadway Reconstruction (STM354); CHV42 -Major Intersection Safety (TF353); and CHV55 -Castle Park Improvements (STL342 only); and WHEREAS, the TransNet Local Street Improvement Program of Projects for Fiscal Years 2012/2013 through 2016/2017 reallocates the funds from completed projects to other TransNet eligible projects; and WHEREAS, the City Of Chula Vista has held a noticed public meeting on March 27, 2012, with an agenda item that clearly identified the proposed list of projects prior to approval of the projects by its authorized legislative body in accordance with Section 5(A) of the TransNet Extension Ordinance and Rule 7 of SANDAG Board Policy No. 31; and NOW THEREFORE, BE IT RESOLVED that pursuant to Section 2(C)(1) of the TransNet Extension Ordinance, the City Of Chula Vista certifies that no more than 30 percent of its annual revenues shall be spent on maintenance-related projects. 6-24 Resolution No. Page 2 BE IT FURTHER RESOLVED that pursuant to Section 4(E)(3) of the TransNet Extension Ordinance, the City of Chula Vista certifies that all new projects, or major reconstruction projects, funded by TransNet revenues shall accommodate travel by pedestrians and bicyclists, and that any exception to this requirement permitted under the Ordinance and proposed shall be clearly noticed as part of the City of Chula Vista's public heazing process. BE IT FURTHER RESOLVED that the pedestrian exclusion on the east side of Industrial Blvd. north of Anita Street be approved because roadway construction will only be done along the west side of Industrial Blvd. and addition of said sidewalk on the east side would not provide continuous access. This exception has been noticed as part of the public hearing process. BE IT FURTHER RESOLVED that pursuant to Section 8 of the TransNet Extension Ordinance, the City of Chula Vista certifies that the required minimum annual level of local discretionary funds to be expended for street and road purposes will be met throughout the 5- year period consistent with the most recent Maintenance of Effort Requirements adopted by SANDAG. BE IT FURTHER RESOLVED that pursuant to Section 9A of the TransNet Extension Ordinance, the City of Chula Vista certifies that it will collect $2,165, plus all applicable annual increases, from the private sector for each newly constructed residential housing unit in that jurisdiction to comply with the provisions of the Regional Transportation Congestion Improvement Program (RTCIP). BE IT FURTHER RESOLVED that pursuant to Section 13 of the TransNet Extension Ordinance, the City of Chula Vista certifies that it has established a separate Transportation Improvement Account for TransNet revenues with interest earned expended only for those purposes for which the funds were allocated. BE IT FURTHER RESOLVED that pursuant to Section 18 of the TransNet Extension Ordinance, the City of Chula Vista certifies that each project of $250,000 or more will be clearly designated during construction with TransNet project funding identification signs. BE IT FURTHER RESOLVED that the City of Chula Vista does hereby certify that all other applicable provisions of the TransNet Extension Ordinance and SANDAG Board Policy No. 31 have been met. BE IT FURTHER RESOLVED that the City of Chula Vista agrees to indemnify, hold harmless, and defend SANDAG, the San Diego County Regional Transportation Commission, and all officers and employees thereof against all causes of action or claims related to City of Chula Vista's TransNet funded projects. BE IT FURTHER RESOLVED that the City Council of the City of Chula Vista adopts the TransNet Local Street Improvement Program of Projects for Fiscal Years 2012/2013 through 2016/2017 for inclusion in the RTIP. 6-25 Resolution No. Page 3 BE IT FURTHER RESOLVED that the City of Chula Vista has added to the 2012 RTIP the Heritage Road extension from Olympic Parkway to Main Street funded with local development fees, because the need for the road will occur within the next the five fiscal years. BE IT FURTHER RESOLVED that the prior year TransNet funds, previously allocated to projects now complete, will be programmed as follows: • CHV 18 -Fourth Avenue Sidewalk Improvements (STL291): $25,000 • CHV33 -Enhanced Traffic Calming Crosswalk Improvements at the vicinity of Montgomery Elementary School (STL375): $80,000 • CHV08 -Willow Street Bridge (Traffic Signal Design): $75,000 • CHV59 -Sidewalk Installation along Naples Street (STL365): $90,000 • CHV50 -Emergency Storm Drain Repair: $250,000 • CHV22 - CIP Management (OP208): $15,8~~ Presented by Richard A.
