The second value that I will work to promote is Independence. You have asked for a City Attorney who is independent from the Council and City officials. I come to this election as the only candidate qualffiedto be that independent City Attorney, Unlike my opponent, I have no ties to the City of Chula Vista that would cause someone to worry abaut the appearance of impropriety or bias, Myonly desire is to provide good, solid and unbiased legal advice that yourelected officials can count on and that you as citizens deserve. The final value that I will emphasize as City Attorney is Open Government. As your independently elected city attorney I promise to broadly interpret any statute, court rule of other authority that furthers your right of access to information concemi ng the conduct of the people's business. WHAT BRINGS- ME HERE TODAY IS THAT I READ ANARTICLE IN THE SAN DIEGO UNION TRIBUNE DATED THURSDAYMARCH 8TH 2012. THE HEADING IS; CITYATTORNEYSQUABBLE SURFACES IN CHULA VISTA. I WILL LEAVE WITH YOU COPIES OF THAT ARTICLE. ALONG WITH MYSTATEMENT IN FEW DAYS I WILL BE EIGHTY YEARS OLD, AND I BELIEVE THAT I AM STILL WITH MY COMMON SENSE AND CONCERN FOR OTHERS TO SOME I AM COMPARED TO PETER FALK, BEST KNOWNAS COL UMBO. YES AND LIKE HIM - AM VERYPERSISTENT IN MYSEARCH OF THE TRUTH IN READING THAT ARTICLE, AN OLD ADAGE CAME TO MIND - ONE SHOULD BE CAREFUL OF WHAT ONE WISHES FOR - WHICH I BELIEVE CAN BE APPLIED TO THE CITYATTORNEY ISSUE. THE PEOPLE OF CHULA VISTA DECIDED THEY WANTED AN ELECTED PERSON IN THAT POSITION. THE ISSUE WAS WELL THOUGHT OUT, THEN REVIEWED AND PUT TO THE VOTERS. OUR FIRST ELECTED CITYATTORNEYNOW ASSUMES HIS POST THERE ON THE DIAS, AND I MIGHT ADD, THAT I HAVE NEVER MET HIM. B UT IT SEEMS HE MUST BE DOING A GOOD JOB, AS I HAVE YET TO READ OTHER WISE . THAT ARTICLE CAUSED ME TO FLASH BACK IN TIME TO SOME CHULA VISTA HISTORY ONCE THERE WAS WEAL THYMAN WHO WAS NOT HAPPY WITH THE WAY THINGS WERE BEING DONE BY OUR THEN CITYADMINIS TRA TION. HE HAD JUST SOLD A BANK AS I RECALL FOR SOMETHING LIKE TEN MILLION DOLLARS HE RAN IN OPPOSITION TO A WOMAN WITH ROOTS INKENTUCKYBUT WHOSE HEART WAS IN CHULA VISTA AND BUSINESS WOMAN TOO. SHE RAISED A FEW B UCKS, WALKED NEIGHBOR HOODS, POSTED SIGNS AND WAVED AT PASSING CARS. SHE WON, AND NOW TO A POINT; - THE PEOPLE OF CHULA VISTA ARE NOT FOR SALE. NOT THEN AND HOPEFULLYNOT NOW. BACK TO THE PRESENT; IT NOW SEEMS THAT TWO POLISHED POLITICIAN ARE AGAIN WITH MAN WITH DEEP POCKETS. WHOSE A GENDA I AND OTHERS ARE YET TO UNDERSTAND. IT SEEMS NOW, THAT THE CITYATTORNEY WASN'T THERE CHOICE IN THE ELECTION. SO THEYNOW WANT US TO CHANGE THE EXISTINGAGREEMENT . BECAUSE THE CITYATTORNEYHAS FOUND FLAWS IN SOME OF THERE DEALINGS, AS MENTIONED IN THAT ARTICLE AT FIRST REFUSE TO FESS TO WHAT THEY WERE ABOUT. THEN TRY TO EXPLAIN IT AWAY. NOT THE IMAGE I WANT THE WORLD TO SEE. ONE OF THE TWO SETTING POLITICIANS WANTS TO SPEAK FOR US. SAYING WE DIDN'T UNDERSTAND THE NITTY - GRITTY OF WHAT WE HAVE GOTTEN OUR SELVES INTO WITH OUR ELECTED CITYATTORNEY NOT SO: THE PEOPLE OF CHULA VISTA DO, AND HAVE SPOKEN - OUR CITYA TTORNE Y IS DOING WHAT WE EXPECT OF HIM. HE'S NOT ONE OF YOU YOUR RIGHT - -BUT IS TO BE INDEPENDENT OF YOU AS HE HAS DONE ON THIS ISSUE AS FOR HIS SALARY- I EXPECT HIM TO BE PAID EQUAL TO HIS PEERS - AS IS DONE WITH MOST ADMINISTRATIVE POSITIONS. IF HE CAN PREVAIL IN JUST ONE CASE AGAINST THIS CITY AND GIVE YOU THE GUIDANCE THAT IS NEEDED, THEN THE MATH WORKS OUT IN OUR FAVOR. THESE SAME FOLKS SEEM TO BE WORRIED ABOUT OVER PAYING OUR CITYATTORNEY THEN ON THE OTHER HAND ARE WILLING TO SPEND BIG MONEY ON SPECIAL ELECTIONS. NOT A MATH MAJOR BUT AGAIN, THAT JUST DOESN'T MAKE SENSE TO ME. AGAIN ON THE SUBJECT OF MONEYAND HOW IT CAN INFL UENCE ONES ACTIONS. AGAIN GOING BACK IN TIME I CAN RECALL WHEN ONE OF OUR COUNCIL WAS CAMPAIGNING FOR HIS NOW SEAT. HE WAS A REPUBLICANAND WHEN THEY REFUSED TO FUND HIM, HE BECAME AN INSTANT DEMOCRAT AND WAS GIVEN BIG B UCKS BYAN OUT OF STATE UNION, AND AS YOU CAN SEE HE WON. I STILL HAVING TROUBLE WITH THAT ONE. FOLKS TRULYI DON'T TAKE PLEASURE IN COMING BEFORE YO U WITH THIS - B UT I REFUSE TO SIT BACK AND LET BAD THINGS HAPPEN TO THE CITY FOR WHICH I DEDICATED MUCH OF MYLIFE TOO LIKE I HAVE SAID ON PRIOR OCCASIONS BEFORE YOU, I WILL PRAISE YOU FOR YOUR GOOD DEEDS, B UT IF I SEE CONFLICT, I SHALL RETURN. YES, MUCH LIKE MY MENTOR - COL UMBO 'CITY ATTORNEY SQUABBLE SURFACES IN CHULA VISTA Voters to decide on E limiting authority WENDY FRY • U -T d CHULA VISTA Voters will decide in June whether to place linikson the F authority and salary of the _ elected city attorney. o The City Council decided w 3 -2 early Wednesday, min- A utes past midnight after a z marathon eight -hour coun- cil meeting, to put forward a F ballot measure in the June 5 general election. The propo- sition is a result of a lengthy Z power struggle between the =) council majority and City v Attorney Glen Googins, who x was elected in 2010. 5 The measure will ask vot- N ers if they want to limit the authority and compensation of the city attorney, establish term limits for the office, and establish an independent le- gal office. The issue stems partly from a meeting in August, when Googins told the coun- cil that removing his author- ity to advise a committee that evaluates misconduct complaints' against top city officials would require a spe- cial vote of the people and a charter amendment. "There is no more conflict in your duty to make the pol- icy than there is in my char- ter- directed duty to actually advise on those policies to the various boards and com- missions that take up these issues," he said then. The June ballot measure would give the City Council the authority to establish an outside Office of Legislative Counsel to advise the city should concerns about con- flicts of interest arise. "It would essentially re- align some of the duties of the city attorney," said Dep- uty Mayor Steve Castaneda, who brought forward the proposal. "As we all know, voters approved an elected city attorney. I did not sup- port that measure. I think there were a number of flaws in it, and unfortunately a lot of voters don't get down into the nitty- gAtty." "There are some inherent conflicts with respect to the fact that we now have a pub- licly- elected city attorney, and in essence, one more poli- tician up here on the dais," he added. . A June ballot measure could cost taxpayers between $80,000 and $100,000, ac- cording to City Clerk Donna Norris. The manner in which the proposition was originally brought forward caused a stir. The draft document first appeared around 11 p.m. at a `Feb. 14 meeting when coun- cilmen Steve Castaneda and Rudy Ramirez began discuss- ing it. No other council members or city staff appeared to have a copy. Googins advised the two council members that the document could not be dis- tributed and discussed on the spot in accordance with the Brown Act, a state law that mandates thepublic be given prior notice of issues slated to be discussed. AEeb.16 public records re- quest by U T $an Diego pro- duced no correspondence to describe how the resolution came to be drafted or who paid for any" legal research involved. "Who paid for this docu- ment that was produced on the dais at the last council meeting and then emailed to us the next day?" Bensoussan asked Tuesday night. Ramirez said he was un- willing to answer. "You know, I'm here, and I serve the people of Chula Vista. I'm not here to answer other questions from other council members," Ramirez said. "So, you won't tell us who paid for it ?" Mayor Cheryl Cox chimed in. "I have no comment," Ramirez answered. The response did not sat- isfy Bensoussan, who was mentioned in a U T San Di- ego story last year concern- ing her use of private email to conduct negotiations about the South Bay Power Plant. "We all have, at one time or another, taken individual pledges to conduct govern- ment in an open or trans- parent manner, and this mysterious document just materialized," said Bensous- san, who joined Cox in opposi- tion. "I believe the public has the right to know who. paid for it and who prepared it:' The council members declined to answer Tues- day night, but on Wednes- day, Castaneda said he met months ago with landowner Earl Jentz and Ramirez to draft objectives of the pro- posed ballot measure. Jentz declined to state who wrote the legislation or how much he paid for a legal analysis of it. "The focus was to put the issues before the voters so the public could decide," said Jentz, who provided most of the campaign funding for the 2008 proposition creat- ing an elected city attorney position. Jentz, 69, and his wife, Kar- en, each spent about $50,000 on Googins' opponent in the 2010 city attorney's race, through independent ex- penditures. That money also supported two other council members who were funded to a lesser degree. Googins currently has a base salary of about $208,000 annually and there are no term limits on his office. The proposed measure would align his salary with those of Superior Court judges, who are now paid $178,789 a year, instead of basing it on comparable city attorney positions across the state. wendy.fry @utsandiega.com 619- 293 -1743 Twitter: @utsdFry Contact South County staff Wendy Fry, (619) 293 - 1743, wendy.fry @utsandiego.com Tawny Maya McCray (619)2934859, tawny.mccray -@ utsandiego.com John Cannon, editor, (619) 293 -1374, john.cannon@ utsandiego.com ark Croshiez a r c ~ a '~ A .-• v J~ : ' '_' ~~ ~~ ~ ~' , ~• ~a 'r' ~ ' < M : ~ ~. , . . .. ~a e ~ ~: ~ ~ re O ~ L: ^*+ ~, rr . ~ ,~ n ~. ~ _ ro rt ~t co rp ~ °-' ~ ry ~ O ~ ~ ~ ^ f 9 . r a ~_. ~ G ".S ~ qa ~ ~ ~ ~ R C C ~ ~ ~ ' __ d ~ d ~ ~' ~ `~' ~, b ~ ~ C ® ® ~ ~ '~ ~ U ~ ~ ~~ ,.~ ~ d a ~ ~~ w ~~,,, ° ~ tnrl ^ U ~ - ~ ~ ~ ~ o ~ ~ o ~ ~ ~ ~ ~ c- c~ a j `~I~ ~ ~ ~ ~' m O r cfl o CZ. ~ ~ ~ o ~' '~' ,~ ~, y H ~ ~ ~ ~~ ~ ` ~ ~' t~J o y ~ x~ ~ ~, ~ o y ~~~ ~ o ~ ~ '~ n o~ o ~~ ~ ~ ~ .~ ~ ~ ~ _ ~~~ ~~ r ~~ ~~ ~ r ,,~ ~ VV - ) i c ~ A G ~~' ff ~ ~~ o ~ ~' ~ ~-~ ~~ ~ ~ V' J _ - ~ ; to .."~ i ~ ~ .~ ~ ~i~I ~~ Mark Croshiez 3~73/2oi2 U~~~ t~Y?
