Voters will decide in June
whether to place linikson the

_ elected city attorney.
o The City Council decided
w 3 -2 early Wednesday, min-
A utes past midnight after a
z marathon eight -hour coun-
cil meeting, to put forward a
F ballot measure in the June 5
general election. The propo-
sition is a result of a lengthy
Z power struggle between the
=) council majority and City
v Attorney Glen Googins, who
x was elected in 2010.
5 The measure will ask vot-
N ers if they want to limit the
authority and compensation
of the city attorney, establish
term limits for the office, and
establish an independent le-
gal office.
The issue stems partly
from a meeting in August,
when Googins told the coun-
cil that removing his author-
ity to advise a committee
that evaluates misconduct
complaints' against top city
officials would require a spe-
cial vote of the people and a
charter amendment.
"There is no more conflict
in your duty to make the pol-
icy than there is in my char-
ter- directed duty to actually
advise on those policies to
the various boards and com-
missions that take up these
issues," he said then.
The June ballot measure
would give the City Council
the authority to establish an
outside Office of Legislative
Counsel to advise the city
should concerns about con-
flicts of interest arise.
"It would essentially re-
align some of the duties of
the city attorney," said Dep-
uty Mayor Steve Castaneda,
who brought forward the
proposal. "As we all know,
voters approved an elected
city attorney. I did not sup-
port that measure. I think
there were a number of flaws
in it, and unfortunately a lot
of voters don't get down into
the nitty- gAtty."
"There are some inherent
conflicts with respect to the
fact that we now have a pub-
licly- elected city attorney,
and in essence, one more poli-
tician up here on the dais," he
added. .
A June ballot measure
could cost taxpayers between
$80,000 and $100,000, ac-
cording to City Clerk Donna
Norris.
The manner in which the
proposition was originally
brought forward caused a
stir.
The draft document first
appeared around 11 p.m. at a
`Feb. 14 meeting when coun-
cilmen Steve Castaneda and
Rudy Ramirez began discuss-
ing it.
No other council members
or city staff appeared to have
a copy.
Googins advised the two
council members that the
document could not be dis-
tributed and discussed on the
spot in accordance with the
Brown Act, a state law that
mandates thepublic be given
prior notice of issues slated
to be discussed.

"Who paid for this docu-
ment that was produced on
the dais at the last council
meeting and then emailed to
us the next day?" Bensoussan
asked Tuesday night.
Ramirez said he was un-
willing to answer.
"You know, I'm here, and
I serve the people of Chula
Vista. I'm not here to answer
other questions from other
council members," Ramirez
said.
"So, you won't tell us who
paid for it ?" Mayor Cheryl
Cox chimed in.
"I have no comment,"
Ramirez answered.
The response did not sat-
isfy Bensoussan, who was
mentioned in a U T San Di-
ego story last year concern-
ing her use of private email to
conduct negotiations about
the South Bay Power Plant.
"We all have, at one time
or another, taken individual
pledges to conduct govern-
ment in an open or trans-
parent manner, and this
mysterious document just
materialized," said Bensous-
san, who joined Cox in opposi-
tion. "I believe the public has
the right to know who. paid
for it and who prepared it:'
The council members
declined to answer Tues-
day night, but on Wednes-
day, Castaneda said he met
months ago with landowner
Earl Jentz and Ramirez to
draft objectives of the pro-
posed ballot measure.
Jentz declined to state
who wrote the legislation or
how much he paid for a legal
analysis of it.
"The focus was to put the
issues before the voters so
the public could decide," said
Jentz, who provided most of
the campaign funding for
the 2008 proposition creat-
ing an elected city attorney
position.
Jentz, 69, and his wife, Kar-
en, each spent about $50,000
on Googins' opponent in the
2010 city attorney's race,
through independent ex-
penditures. That money also
supported two other council
members who were funded
to a lesser degree.
Googins currently has a
base salary of about $208,000
annually and there are no
term limits on his office.
The proposed measure
would align his salary with
those of Superior Court
judges, who are now paid
$178,789 a year, instead of
basing it on comparable
city attorney positions
across the state.

THAN MOST CITIES PER CAPITA
I SEE B USINESS ON THIRD AVENUE IN DIRE
NEED OF HELP TO SURVIVE.
IMPROVE IT, MAKE ITANATTRACTIONAND THEY
WILL COME.
IF DONE WELL WILL HELP TO PROVIDE THE
FUNDS FOR THAT PARKAND OTHER NEEDS.
