The property consists of 1.19 acres and lies west of the Halecrest School. The State has prepared a lease agreement to be executed by the City. The major conditions contained in the agreement are: 1. 50-year lease period. 2. Rental rate of $100 per year. 3. Termination by the State on 180 days notice. 4. City is to develop a park within a limited time.. The commencement date and completion date of the park development are yet to be inserted in the agreement. The Department of Parks and Recreation recommends the followi dates for insertion: Commence construction December 1, 1972, complete con- struction June 1, 1973, 5. All plans and specifications for park improvement work to be submitte to the State for their review and approval prior to commencing work. 6. The property may not be subleased without State approval and is to be used for park purposes only. The contract may be terminated by the State for breach of the conditions by the City or in the event that the property is needed for public transportation purposes. See EXHIBITS (~ ] No• 1, 2, 3 Financial Statement: Park development is in the proposed 1972-73 Capital Improvements .Program. First year's annual rent payment of $100 is included in 1972-73 budget account 12-4120-5271 Commission-Board Recommendation: On August 19, 1971, the Park and Recreation Commission approved the landscape plan for this site, presented to them by the Landscape Planner Department Head Recommendation Recommends approval of the lease agreement. The City Council modified Section 4 on page 6 to provide for the completion of the improvements six months after receipt of approved plans from the State. Page 5 wad - typed in that the original agreement utilized both aides of the page. Please transmit a completely executed copy to this office upon action by the State. LANE F.
