Item Title: Resolution - Opposing Proposition g, the So-Called Pollution
initiative, on June 6 ballot

Background:
The City Council received a letter under. Council correspondence
far May 23, 1°72, urging opposition to Proposition 9• Since
there will be no Council meeting until the day of the election,
it is incumbent upon the Council, if it so chooses, to enact
on May 23, 1972, a resolution expressing opposition to Prop-
osition 9.
A unanimous consent resolution has been prepared for consider-
ation of the Council.

Recommendation:
It is the opinion of the City Attorney that Proposition g constitutes
Depart~rlent Head one of the most drast i c attacks on 1 egal i nst i tut ions of the American
Recomm~ndat?_on• social order ever postulated. Aside from the fact that it may not
• only not achieve its intended goal of improving the environment, it
will clearly undermine Constitutionally guaranteed rights of due process
and, therefore, the City Attorney urges Council apposition to Proposi-
City A9anager t ion g.
