The City Council, by Resolution 5644, on May 12, 1970, approved an aur.eement
between the City of Chula Vista and the County of San Diego for the mprove-
ment of_ "I-I" Street. This agreement, which was executed on June 3, 1970,
states in paragraph (1) that the agreement becomes null and void if the Citv
is unable to nc~got.i.ate an agreement with the California Division of Highways
for the construction o.f. a grade separation at Interstate Route 805, and an
agreement with the owner or developer of the land for the construction of "II'
Street easterly from 805 to Otay Lakes Road within two years of the date of
the agreement.
The City has been ir. the process of negotiating an agreement with the
developer a.nd has exchanged several drafts. However, it is evident that an
agreement with the developer will not be consumated prior to the expiration
of the cooperative agreement between the City and the County. The agreement
with the developer is necessary to satisfy the requirement of the Division o
Highways in regard to the construction c" the interchange between "H" Street
and Interstate 805 Freeway.
The attached "First Amendment to Agreement" amends Section 1 of the cooperat
agreement between the City and the County whereby said agreement becomes nul
and void within three (3) years after the date of said agreement if the Ci_ty_
is unable to negotiate the required agreements with the California Divisionz
of Highways and developer. The expiration date of the cooperative agreement
between the City and County would thereby be extended to June 3, 1973.

Recommendat~_on: authorize the Mayor to execute the attached document on
behalf of the City. The original and two copies of the
executed "First ~'unendment to Agreement" are to be returned
to the County Engineer for transmittal to the Eoard of
City P~lanager Supervisors.
