McAlpine Construction, Inc., in accordance with the contract agreement dated. August 27, 1971. The Council, at the meeting of April 18, 1972, extended the completion ,~_'f'' ~ date of this project to March 16, 1972. The building was ready f.or =r~k,,, occupancy by the tennis pro on April. 21, 1972. Therefore, liquidated ,.. ~ ~ damages will be assessed-from March 17, 1972 to April 20, 1972- a "',,r~ A.~~t'-~ total of 35 days. The liquidated damages will amount t ~~1750.--- ' C~, ry ~`~ s,:•~.~ A final inspection was made on April 21, 1972, and all of the public ~`U improvements in the project have been completed to the satisfaction of the Public Works Director and in accordance with the requirements of the City. It is recommended that the City Council, by resolution, accept these public improvements. Counci-1 received a communication from McAlpine Construction, Inc., requesting the continuance of .this item from the May 2 meeting to May 9. It appears as though the contractor asked far the delay as he is developing a case for a request far a time extension credit on new grounds. He is in contact with the architect, who will be present at the Cauncil meeting. Staff has received no specific information to date in this regard. See EXFIIBITS [x ] Pdo. 1 Recommends acceptance of the public improvements. City Manager e~oncur. It is noted that the contractor must replace the Recorunendation: water heater W]11C}1 presents Ile problem since arrangements have been made. Interest to Council that the furniture will arrive [~1ay 1.5, which has no direct effect oil the contract.
