HomeMy WebLinkAboutReso 2000-269 RESOLUTION NO. 2000-269 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA, APPROVING THE BALLOT TEXT, THE IMPARTIAL ANALYSIS AND ARGUMENT IN SUPPORT OF PROPOSED CHARTER AMENDMENTS TO SECTIONS 602 AND 607 TO BE SUBMITTED TO THE ELECTORATE AT THE SPECIAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, NOVEMBER 7, 2000 The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, by Resolution No. 2000-231, the City Council of the City of Chula Vista did call an election to be held on Tuesday, November 7, 2000, for the purposes of electing two members of the City Council; and WHEREAS, at its meeting of July 25, 2000, the City Council approved recommendations of the Charter Review Commission to place a Charter amendment measure on the November 7, 2000, ballot to modify Section 602(d) relating to the appointment of non-electors of the City of Chula Vista to advisory boards whose duties involve regional issues; and WHEREAS, Elections Code Section 9280 directs the City Attorney to prepare an impartial analysis of each proposed measure to amend the Charter of the City of Chula Vista; and WHEREAS, Elections Code Section 9282 authorizes the City Council, or any member or members of the City Council authorized by the City Council, to file a written argument for any City measure; and NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve the ballot text, the City Attorney' s impartial analysis, attached hereto as Exhibit "A," and written argument, attached hereto as Exhibit "B," in support of proposed Charter amendments to Charter Sections 602 and 607 to be submitted to the electorate at the special municipal election to be held in said City on Tuesday, November 7, 2000. Susan Bigelow, City Clerk i EXHIBIT "A' CITY ATTORNEY'S IMPARTIAL ANALYSIS MEASURE 1: SHALL THE CHARTER OF CHULA VISTA BE AMENDED TO AUTHORIZE, BY A FOUR-FIFTH'S VOTE OF THE COUNCIL, THE APPOiNTMENT OF NON-ELECTORS OF THE CITY OF CHULA VISTA TO ADVISORY BOARDS WHOSE DUTIES iNVOLVE REGIONAL ISSUES7 This proposition would amend Article VI, Section 602 authorizing the City Council to appoint with a four-~fth's vote non-electors of the City of Chula Vista advisory boards whose duties involve regional issues. This would allow the City Council to appoint non-resident individuals with specialized expertise on regional issues to advisory boards when it is in the best interests of the City to do so. This measure has no fiscal impact. EXHIBIT "B" ARGUMENT IN FAVOR OF MEASURE MEASURE 1: SHALL THE CHARTER OF CHULA VISTA BE AMENDED TO AUTHORIZE, BY A FOUR-FIFTH'S VOTE OF THE COUNCIL, THE APPOINTMENT OF NON-ELECTORS OF ,THE CITY OF CHULA VISTA TO ADVISORY BOARDS WHOSE DUTIES iNVOLVE REGIONAL ISSUES? The Environmental Legacy Fund and the Bayfront Conservancy Trust met on April 27,2000 and made a recommendation to restructure the Bayfront Conservancy Trust organization to more closely resemble a City board and commission. Currently, the membership of both the Environmental Legacy Fund and Bayfront Conservancy Trust consists of individuals from a variety of governmental agencies and scientific and educational communities. Under the proposed reorganization, the Bayfront Conservancy Trust is proposing to dissolve as a non-profit organization and become an advisory board of the City. The Environmental Legacy Fund would continue as the Nature Center's fundraising organization in a modified form. In order to retain individuals with the same qualifications on a City-created board, it would be necessary to give the Council the ability to appoint non-residents when required. This change may also address the desires of the Library Board of Trustees to include members from surrounding communities as appropriate.
