RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA
AMENDING RESOLUTION NO. 5219 BY CHANGING THE DATE WHICH
AFFECTED PROPERTY OWNERS OF THE UNDERGROUND UTILITIES
DISTRICT MUST BE READY TO RECEIVE SERVICE AND DATE WHEN ALL
OVERHEAD FACILITIES WILL BE REMOVED
The City Council of the City of Chula Vista does hereby resolve
as follows:
WHEREAS, Resolution No. 4964 pursuant to Ordinance No. 1128 of
the City of Chula Vista declared a certain underground utility district
and designated such in the City of Chula Vista in accordance with Exhibit
A attached thereto, and
WHEREAS, said resolution established certain dates upon which
affected property owners must be prepared to receive service and when
all overhead facilities would be removed, and
WHEREAS, it has been determined that said dates should be changed
placing said dates at a later period in time, and
WHEREAS, the dates established in said resolution whereon the
property owners were to have been ready to receive underground utilities
service were changed by an amendment thereto in Resolution No. 5219, adopted
on June 3, 1969, and
WHEREAS, it has been determined that said dates should be further
changed placing said dates at a later time.
NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby
fix Friday, the 3rd day of October, 1969, as the date on which affected
property owners must be ready to receive underground service, and does
hereby order the removal of all poles, overhead wires and associated
overhead structures and the underground installation of wires and
facilities for supplying electric, communication or similar or associated
service within said Underground Utility District on or before the 28th
day of November, 1969.
BE IT FURTHER RESOLVED that the City Clerk is hereby instructed
to notify all affected utilities and all persons owning real property
within said Underground Utility District of the adoption of this resolution
within ten (10) days after the date of such adoption. Said City Clerk
shall further notify said property owners of the necessity to receive
electric, communication or other similar or associated service, they or
such occupant shall, by the date fixed in this resolution, provide all
necessary facility changes on their premises so as to receive such service
from the lines of the supplying utility or utilities at a new location, subject
to the applicable rules, regulations and tariffs of the respective utility
or utilities on file with the Public Utilities Commission of the State of
California as of the date of adoption of this resolution. Such notification
shall be made by mailing a copy of this resolution, together with a copy of
said Ordinance No. 1128 to affected property owners as such are shown on
the last equalized assessment roll and to the affected utilities.
