RESOLUTION NO. 5316
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA
SUPPORTING THE PROPOSED COMPROMISE BETWEEN THE NATIONAL
ASSOCIATION OF BROADCASTERS (NAB) AND THE NATIONAL CABLE
TELEVISION ASSOCIATION (NCTA) AND URGING THE HOUSE COMMUN-
ICATIONS SUBCOMMITTEE TO PROPOSE LEGISLATION TO EFFECTUATE
SAID COMPROMISE
The City Council of the City of Chula Vista does hereby resolve
as follows:
WHEREAS, the House Communications Subcommittee of the House
Commerce Committee has heretofore conducted hearings from May 16, 1969
to May 21, 1969 for the purpose of determining whether or not existing
Federal Communications Commission rules which Beverly restrict CATV
systems, worked a disadvantage to those communities wherein CATV was
operating, and
WHEREAS, said subcommittee will continue further hearings in
regard to said rules., and
WHEREAS, the National Association of Broadcasters (NAB) and the
National Cable Television Association (NCTA) have heretofore held a
series of meetings in the attempt to work out industry differences, and
WHEREAS, said meetings resulted in the following proposed com-
promises:
1. All television signals already reaching a community, whether
from within the city or from another city, could be carried by the
CATV system.
2. If available signals reaching the community did not include
all three network channels plus three full-time commercial independent
channels, the CATV could carry additional channels brought in from a
distance.
3. The CATV industry agreed to pay copyright royalties for the
right to carry these programs.
4. The CATV industry agreed to bring far-distant signals into
a community when nearer channels were available, and agreed not to
interconnect CATV systems into an entertainment network.
5. Of special importance to cities, the CATV systems would have
had unlimited right to produce their own public service programming. In
addition, they could provide entertainment programming on an unused
channel and provide a new outlet for local advertising on it.

WHEREAS, said compromise was acceptable to the National Cable
Television Association (NCTA) but has apparently been rejected by the
board of the National Association of Broadcasters (NAB), and
WHEREAS, it is desirable to the City of Chula Vista that the
severe limitation presently imposed by the Federal Communications
Commission rules be lifted as soon as possible, and
WHEREAS, the compromise appears to be a reasonable solution which
would allow for the removal of said severe restrictions.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Chula Vista on behalf of themselves and the citizens of this community
who have evidenced a great and continuing interest in the use of the
cable television system does hereby endorse said proposed compromise
and urges its acceptance to all parties of the controversy and urges
the House Communications Subcommittee to recommend legislation embodying
the proposed compromise and removing the restrictive rules presently
imposed by the Federal Communications Commission.
BE IT FURTHER RESOLVED that the City Clerk of the City of Chula
Vista be, and he is hereby authorized and directed to send certified
copies of this resolution to John J. Gunther, United States Conference
of Mayors, 1612 K Street Northwest, Washington, D.C. 20006; National
Cable Television Association and National Association of Broadcasters;
Congressmen Torbert Macdonald, Chairman of the Communications Subcommittee
of the House Communications Subcommittee; Lionel Van Deerlin, and Bob
Wilson.
