RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA, APPROVING AGREEMENT BETWEEN THE CITY OF CHULA
VISTA AND CHARLES F. AND EMMA M. KOKAI FOR THE SALE
AND PURCHASE OF CERTAIN REAL PROPERTY FOR ACCESS ROAD
AND OTHER PUBLIC PURPOSES, APPROPRIATING FUNDS FOR
SAID PURCHASE, AND AUTHORIZING THE MAYOR TO EXECUTE
SAID AGREEMENT
The City Council of the City of Chula Vista does hereby
resolve as follows:
NOW, THEREFORE, BE IT RESOLVED that that certain agreement
between the City of Chula Vista, a municipal corporation, and Charles F.
and Emma M. Kokai, husband and wife as joint tenants, for the sale and
purchase of certain real property for access road and other public
purposes, dated the 28 day of OCTOBER 19 69 a
copy of which is attached hereto and incorporated herein, the same as
though fully set forth herein be, and the same is hereby approved.
BE IT FURTHER RESOLVED that the sum of $5,100.00 be, and
the same is hereby appropriated from the unappropriated reserve of
the General Fund for the purchase of said real property, and for the
City's share in the escrow and title policy costs.
BE IT FURTHER RESOLVED that the Mayor of the City of Chula
Vista be, and he is hereby authorized and directed to execute said
agreement for and on behalf of said City.

AN AGREEMENT FOR THE SALE AND PURCHASE OF
CERTAIN REAL PROPERTY FROM CHARLES F. AND
EMMA M. KOKAI, HUSBAND AND WIFE, AS JOINT
TENANTS
THIS AGREEMENT, made and entered into this 28 day of
OCTOBER 1969, by and between the CITY OF CHULA VISTA, a
municipal corporation, hereinafter referred to as "Buyer", and
CHARLES F, and EMMA M. KOKAI, husband and wife, as joint tenants,
hereinafter referred to as "Sellers";
W I T N E S S E T H
WHEREAS, Sellers are the owners of certain real property
hereinafter described, being a parcel of record located in the City
of Chula Vista, County of San Diego, State of California, described
as a lot, or a portion of a lot or lots of record, and
WHEREAS, Sellers wish to sell, and Buyer wishes to
purchase said real property to be used for access road purposes and
other public purposes in the City of Chula Vista, County of San
Diego, State of California, and
WHEREAS, the parties hereto have reached an agreement which
they now wish to reduce to writing.
NOW, THEREFORE, IN CONSIDERATION OF THE PREMISES contained
herein and for other good and valuable consideration, receipt of
which is hereby acknowledged, the parties hereto agree as follows:
1. Sellers agree to sell, and Buyer agrees to purchase
that certain real property situate in the City of Chula Vista, County
of San Diego, State of California, more particularly described as
All that portion of Section 113 of Rancho de la Nacion,
in the City of Chula Vista, County of San Diego, State
of California, according to Map thereof No. 166, filed
in the office of the County Recorder of San Diego County,
May 11, 1869, described as follows:
Beginning at the Northwest corner of the Southerly 65 feet
of Quarter Section 113; thence North 71°6'36" East 122.72
feet to a point on a 460 foot radius curve concave South-
.- westerly whose radius bears North 68°26'59" East to said
point; thence Northwesterly along said curve 65.51 feet;
thence South 71°6'36" West to a point on the Westerly line
of said Quarter Section; thence South 18°30'30" East to
the Point of Beginning in the Southwest Quarter of
Quarter Section 113.
2. The purchase price therefor shall be the sum of FIVE
THOUSAND DOLLARS ($5,000.00).
3. Buyer agrees to deposit said amount in an escrow estab-
lished to provide for the transfer of title to said property upon
the approval of this agreement by the City Council of the City of
Chula Vista, which deposit will be undertaken not more than fourteen
(14) days from the execution of this agreement by Sellers. Sellers
agree to share all normal costs of escrow and provide a good and valid
title policy for said property, the cost of which the City agrees to
share on a fifty-fifty basis.

4. This agreement shall bind, and inure to the benefit of,
the heirs, executors, administrators, successors and assigns of the
parties hereto.
IN WITNESS WHEREOF, the parties hereto have caused this agree-
ment to be executed the day and year first hereinabove set forth.
