Alagata, authorizing said property owner to connect two single family residences to one 6" lateral sewer line and the acceptance by said property owner of full responsibility for maintenance and repair of said sewer line, dated the 21st day of October 19 of which is attached hereto and incorporated herein, the9samecasy though fully set forth herein be, and the same is hereby approved. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute said agreement for and on behalf of said City. BE IT FURTHER RESOLVED that the City Clerk be, and he is hereby authorized and directed to record said agreement in the Office of the County Recorder of the County of San Dieqo, State of California for and on behalf of said City. ALAGATA TO ~~%-"= CONNECT TWO SINGLE FAMILY RESIDENCES TO ONE 6" LATERAL SEWER LINE AND THE ACCEPTANCE BY SAID PROPERTY OWNER OF FULL RESPONSIBILITY FOR MAIN- TENANCE AND REPALR OF SAID SEWEP. LINE THIS AGREEMENT, made and entered into this 21st day of October , 1969, by and between the CITY OF CHULA VISTA, a municipal corporation, hereinafter called "City" and MR. HANISELI S. ALAGATA, hereinafter called "Owner"; W I T N E S S E T H WHEREAS, Section 26.13 allows the City Engineer to authorize the connection of more than one single family residence to a common sewer lateral, and WHEREAS, Mr. Haniseli S. Alagata has requested said permission to connect two single family residences to one 6" lateral, which houses shall be located on Tax Assessors Parcel No. 619-341-33 and will be identified as Nos. 81 and 83 Quin- tard Street, and WHEREAS, Mr. Alagata has paid the lateral fees and the City forces have installed a 6" lateral to the property line of said properties, and WHEREAS, Owner has obtained a private easement through which said sewer line has been installed which easement runs a distance of 123'+ through Lot 6 Hilltop Terrace View, Unit 1, Map No. 5877, identified as No. 74 Provence Court, and WHEREAS, Owner agrees to accept the full responsibility for the maintenance of said 6" sewer lateral. NOW, THEREFORE, IT IS MUTUP_LLY UNDERSTOOD AND AGREED by and between the parties hereto, in consideration of the premises and for other good and valuable consideration, receipt of which is hereby acknowledged, as follows: 1. Owner, his heirs, successors, assigns and trans- ferees of those properties identified as Nos. 81 and 83 Quintard Street in the City of Chula Vista, does hereby agree to accept the full responsibility for maintenance and repair of a certain 6" sewer lateral line running 123'+ through an easement of Lot 6, Hilltop Terrace View, Unit 1, Map No. 5877, identified as No. 74 Provence Court. 2.
