RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA, CALIFORNIA, RECITING THE FACT OF THE GENERAL
ELECTION HELD IN SAID CITY ON THE 14TH DAY OF APRIL,
1970, DECLARING THE RESULT THEREOF AND SUCH OTHER
MATTERS AS ARE PROVIDED BY LAW
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, a regular general municipal election was held and
conducted in the City of Chula Vista, County of San Diego, State of
California, on Tuesday, the 14th day of April, 1970, as required by
law, and
WHEREAS, notice of said election was duly and regularly given
in time, form and manner as provided by law; that voting precincts were
properly established; that election officers were appointed, and that
in all respects said election was held and conducted and the votes cast
thereat, received and canvassed and the returns made and declared in
time, form and manner as required by the provisions of the Elections
Code of the State of California for the holding of elections in general
law cities, and
WHEREAS, the returns of said election have been duly and
regularly canvassed as provided by law, and all absentee ballots, if
any, returned have been canvassed as provided by law.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Chula Vista as follows:
Section 1. That there were sixty (60) voting precincts
established for the purpose of holding said election, consisting of
consolidation of the regular election precincts in the City of Chula
Vista and the Chula Vista City School District, as established for
the holding of state and county elections.
Section 2. That said regular general municipal election
was held for the purpose of electing the following officers of said
City and City School District, as required by laws relating to general
law cities in the State of California, to-wit:
One (1) Mayor of the City of Chula Vista for a short term of
two ( 2 ) years ;
Two (2) Members of the City Council for a full term of four
(4) years;
One (1) Member of the Board of Education of the Chula Vista
School District for a short term of two (2) years;
Two (2) Members of the Board of Education of the Chula Vista
School District for a full term of four (4) years.
Section 3. That at said regular general municipal election,
the following measures were submitted to the electors of said City,
to-wit:
PROPOSITION A
Amend Article III, Section 301 thereof, of the Charter of
the City of Chula Vista to be, and to read as follows:
Sec. 301. Eligibility.
No person shall be eligible to hold office as a member
of the City Council unless he is, and shall have been for
at least two years preceding his election or appointment,

a qualified elector of the City or of territory annexed
thereto. If a member of the Council shall become a candi-
date for nomination or election to any other elective office
in the City government of the City of Chula Vista, he shall
forfeit his place on the Council effective on the date of
the general municipal election.
PROPOSITION B
Amend Article III, Section 302 thereof, of the Charter of
the City of Chula Vista to be, and to read as follows:
Sec. 302. Compensation for Councilmen.
The Councilmen of the City shall receive, as compensa-
tion for their services an amount equal to one and one-half
(1-1/2) times the amount authorized under State law for
Councilmen of General Law and Charter cities, in accordance
with the schedule established by the State Legislature as
it presently exists or as it may be, from time to time
amended, and shall receive reimbursement on order of the
Council for Council-authorized travel and other expenses
when on official duty out of the City, and in addition,
shall receive reimbursement for actual out-of-pocket
expenses incurred by him in serving as a Councilman.
PROPOSITION C
Amend Article III, Section 304, subsection (c) thereof, of
the Charter of the City of Chula Vista to be, and to read
as follows:
Sec. 304. Presiding Officer, Mayor.
(c) The Mayor shall receive, as compensation for his
services, an amount equal to three (3) times the amount
authorized under State law for Councilmen of General law
and Charter cities, in accordance with the schedule estab-
lished by the State Legislature as it presently exists or
as it may be, from time to time amended, and shall receive
reimbursement on order of the Council for Council-authorized
travel and other expenses when on official duty out of the
City, and in addition, shall receive reimbursement for
actual out-of-pocket expenses incurred by him in serving
as Mayor.
PROPOSITION D
Amend Article VI, Section 605 thereof, of the Charter of
the City of Chula Vista to be, and to read as follows:
Sec. 605. Compensation. Vacancies.
The members of boards and commissions shall receive, as
compensation for their services, such an amount as the City
Council may provide by ordinance, which sum shall not exceed
the amount of FIFTY DOLLARS ($50.00) per meeting of any
such board or commission, and further, said member may re-
ceive reimbursement for necessary traveling and other ex-
penses incurred on official duty when such expenditures
have received authorization by the City Council.
Any vacancies in any board or commission, from whatever
cause arising, shall be filled by appointment by the City
Council. Upon a vacancy occurring leaving an unexpired
portion of a term, any appointment to fill such vacancy

shall be for the unexpired portion of such term. If a
member of a board or commission absents himself from three
regular meetings of such board or commission, consecutively,
unless by permission of such board or commission expressed
in its official minutes, or is convicted of a crime in-
volving moral turpitude, as determined by a court of com-
petent jurisdiction, or ceases to be a qualified elector
of the City, his office shall become vacant and shall be
so declared by the City Council.
PROPOSITION E
Amend Article XI, Section 1106 thereof, of the Charter of
the City of Chula Vista to be, and to read as follows:
Sec. 1106. Tax Limits.
(a) Property Taxes. The City Council shall not levy
a property tax, for municipal purposes, in excess of one
dollar and eighty cents ($1.80) annually on each one hundred
dollars of the assessed value of taxable property in the City,
except as otherwise provided in this Section, unless author-
ized by the affirmative votes of a majority of the electors
voting on a proposition to increase such levy at any election
at which the question of such additional levy for municipal
purposes is submitted to the electors. The number of years
that such additional levy is to be made shall be specified
in such proposition.
(b) Additional Taxes. There shall be levied and col-
lected at the time and in the same manner as other property
taxes for municipal purposes are levied and collected, as
additional taxes, if no other provision for payment thereof
is made
1. A tax sufficient to meet all liabilities of the
City for principal and interest of all bonds or judgments
due and unpaid, or to become due during the ensuing fiscal
year, which constitute general obligations of the City; and
2. A tax sufficient to meet all obligations of the
City to the State Employees' Retirement System for the
retirement of City employees, due and unpaid or to become
due during the ensuing fiscal year.
PROPOSITION F
Amend Article XI, Section 1109 thereof, of the Charter of
the City of Chula Vista to be, and to read as follows:
Sec. 1109. Contracts on Public Works.
Every project involving an expenditure of five thousand
dollars or more for the construction, reconstruction, improve-
ment or repair of public buildings, streets, drains, sewers,
utilities, parks and playgrounds, and other public works,
and the furnishing of supplies, materials, equipment or con-
tractual services for same shall be done by written contract
except as otherwise provided in this Chapter, and the Council,
upon the recommendation of the Administrative Officer, shall
let said contract to the lowest responsible bidder after
notice by publication in the official newspaper for sealed
bids for the work contemplated by one or more insertions,
the first of which shall be at least ten days before the
time for opening bids. If the cost of said public works

project is more than the sum of two thousand dollars but
less than five thousand dollars, the City Council may let
said contract without advertising for bids after the Admin-
istrative Officer or his designated agent has secured com-
petitive prices from interested contractors, which shall
be considered by the Council before said contract is let.
Projects involving the expenditure of two thousand dollars
or less may be awarded without written contract by the Director
of Public Works with the approval of the Administrative Officer.
Whenever practicable, the Director of Public Works or the
Purchasing Agent shall obtain informal bids. The project
shall be awarded to the lowest responsible bidder whose bid
is determined to be, in all respects, most advantageous to
the public interest. The Director of Public Works may solicit
such bids personally, by telephone or mail, and shall submit
to the Purchasing Agent and the Administrative Officer a written
account of the procedures used and the bids thus obtained. A
copy of said informal bidding procedure shall be filed in the
office of the City Clerk as a public record.
The City Council may, however, declare and determine that
in its opinion, based upon estimates approved by, and the
recommendations of, the Administrative Officer, that said
projects may be excepted from the requirements of this section
because the work in question may be performed better or more
economically by the City with its own employees, and by a
resolution to this effect, adopted by at least four affirma-
tive votes of the Council, order the performance of any such
construction, reconstruction, improvement or repair by
appropriate City forces.
All bids, of more than two thousand dollars, shall be
accompanied by either a certified, or cashier's check, or
a bidder's bond executed by a corporate surety authorized
to engage in such business in California, made payable to
the City. Such security shall be in an amount not less
than that specified in the notice inviting bids or in the
specifications referred to therein, or if no amount be so
specified then in an amount not less than ten percent of the
aggregate amount of the bid. If the successful bidder neglects
or refuses to enter into the contract, within the time speci-
fied in the notice inviting bids or specifications referred
to therein, the amount of his bidder's security shall be
declared forfeited to the City and shall be collected and
paid into its general fund and all bonds so forfeited shall
be prosecuted and the amount thereof collected and paid into
such fund.
The City Council shall be competent in awarding any contract
to compare bids on the basis of time completion, provided
that when any award has been made in consideration, in whole
or in part, of the relative time estimates of bidders for
the completion of the work, the performance in accordance
with such time limits shall be secured by a surety bond as
hereinabove provided with adequate sureties and penalties,
and provided further, that for any contract awarded solely
or partially on a specified time for completion, the Council
shall not extend such time limits unless such extension be
recommended by the Administrative Officer and the head of
the department concerned.
The City Council may reject any and all bids presented
and may readuertise in its discretion.

Contracts may likewise be let without advertising for
bids if such work shall be deemed by the City Council to be
of urgent necessity for the preservation of life, health or
property, and shall be authorized by resolution passed by
at least four affirmative votes of the Council and contain-
ing a declaration of the facts constituting such urgency;
provided, however, that nothing in this section shall pre-
vent the Administrative Officer from taking any and all
means necessary to make emergency repairs in the event of
immediate need arising from any calamity or disaster.
PROPOSITION G
Amend the Charter of the City of Chula Vista by deleting
Article VII, "WATER DEPARTMENT" in its entirety.
Section 4. That the whole number of votes cast in said City
(except absent voter ballots) was 11,329 and that the whole number
of absent voter ballots cast in said City was 68 , making a total
of 11,397 votes cast in said City.
Section 5. That the names of persons voted for at said election
for Mayor of the City of Chula Vista are as follows:
Thomas (Tom) Hamilton, Jr.
Charles J. Mackres
Bud Wilson
and
That the names of persons voted for at said election
for Member of the City Council of said City are as follows:
Robert R. McAllister
John (Jack) Sylvester
Robert (Bob) Hastings
James E. Hobel
Will T. Hyde
and
That the names of persons voted for at said election
for Member of the Board of Education of the Chula Vista City School Dis-
trict are as follows:
A. Y. Casillas
Susan J. Fuller
Mitchell Koteff
and
That the propositions voted upon at said election are
as set forth hereinabove, and
That the number of votes given at each precinct
and the number of votes given in the City to each of such person above
named for the respective office for which said person was candidate and
for and against the propositions set forth herein are as swown in Exhibit "A"
attached hereto and made a part hereof by reference.

Section 6. That the City Council does declare and determine
that:
Thomas Hamilton, Jr. was elected Mayor of the City of Chula
Vista for a short term of two (2) years;
James E. Hobel was elected as Member of the City Council of
said City for the full term of four (4) years;
Will T. Hyde was elected as Member of the City Council of
said City for the full term of four (4) years;
A. Y. Casillas was elected as Member of the Board of Education
of the Chula Vista School District for a short term of two (2)
years;
Susan J. Fuller was elected as Member of the Board of Education
of the Chula Vista School District for a full term of four (4)
years;
Mitchell Koteff was elected as Member of the Board of Education
of the Chula Vista School District for a full term of four (4)
years;
and
That as a result of said election, a majority of the qualified
voters voting on Propositions "A", "B", "C", "D" and "E", relating to
Charter changes did not vote in favor thereof, and that said changes were
not carried, and shall not be deemed adopted and ratified, and
That as a result of said election, a majority of the qualified
voters voting on Propositions "F" and "G" did vote in favor thereof, and
that said propositions carried, and shall be deemed adopted and ratified.
Section 7. That the City Clerk shall enter on the records of
the City Council of said City a statement of the results of said election
showing:
(1) The whole number of votes cast in the City, and the Chula
Vista City School District;
(2) The names of the persons voted for;
(3) The propositions voted upon;
(4) The office for which each person was voted for;
(5) The number of votes given at each precinct to each person
and for and against each proposition;
(6) The number of votes given in the City and the Chula Vista
City School District to each person and for and against
each proposition.
Section 8. That the City Clerk shall immediately make and,
upon compliance by the persons elected with the provisions of Sections
11565 and 11568 of the Elections Code of the State of California, shall
deliver to each of such persons so elected a Certificate of Election,
signed by him and duly authenticated; that he shall also administer to
each person elected the Oath of Office prescribed in the State Constitu-
tion of the State of California and shall have them subscribe thereto
and file the same in his office. He shall also require from each of

such respective persons so elected the required loyalty oath and file
the same in his office. Whereupon, each and all of said persons so
elected shall be inducted into the respective office to which they
have been elected.
Section 9. That the City Clerk shall certify to the passage
and adoption of this resolution; shall enter the same in the Book of
Original Resolutions of said City, and shall make a minute of the pas-
sage and adoption thereof in the records of the proceedings of the City
Council of the City of Chula Vista in the minutes of the meeting at
which the same is passed and adopted.
