[ 13 ] CHULA VISTA CITY COUNCIL MEETING OF: November 6, 1973 ITEM TITLE: Resolution - Transferring funds within Parks and Recreation control accounts INITIATED BY: Director of Parks and Recreation BACKGROUND On August 24, 1973, the City of Chula Vista received the amended contract from HUD for the Otay and Larkhaven park acquisition and development grant. Upon receipt of this amended contract, the parks' development must be completed in six month or by February 24, 1974. Originally, PEP was not to be phased out until June 30, 1974, but earlier this year the Department of Labor decided to start the phase-down program a year earlier than anticipated. The PEP per- sonnel for park development went from a high of 12 to the present level of 4. These PEP people were to be used to free regular City forces for work at Otay and Larkhaven Parks. This unexpected early phase-out of the PEP program .put the City in a difficult situation in regard to its Federal contractual commit- ment. If the City asks for an extension of time from HUD for the development of these parks and it is not granted (which seems likely due to HUD's own phase-down and their desire to complete all outstanding projects quickly), the City probably could not finish the required development of Otay and LarkY-v~ve~t Parks in time unless the City Council would grant a transfer of funds from Parks and Recreation Control Accounts 12-4220-5101 (Recreation) and 12-4111-5101 (Parks and Recreation Administration) to Parks and Recreation Control Account 12-4120-5101 (Parks Maintenance). This action will permit the meeting of all commitments as to Parks Development and the grant stipulations despite PEP phase-out setbacks, and within the budget as approved by the City Council. These transfers will provide for five temporary interim staff appoint- ments of Daintenance Gardener I for a six-month period, and overtime monies for. regular City forces. The alternative to a transfer of funds would be to take manpower away from existing park development projects at Hilltop, Halecrest, and Norman Park Center for use in the completion of Otay and Larkhaven Parks. T~lithout the completion of our commitments under the Federal grant agreement, according to the City Attorney, this could possibly result in a breach of contract on the part of the City with the possibility of reimbursement of all or part of the federal funds received.
