[ 10 ] CHULA VISTA CITY COUNCIL MEETING OF: Oc tobe r 16, 197 3 ITEM TITLE: Resolution - Re approving Final Map of Bonita View Terrace Subdivision INITIATED BY: City Attorney BACKGROUND In accordance with Section 28.308 of the Chula Vista City Code, a developer is allowed a period of 60 days in which to deposit necessary bonds and agreements with the City Clerk after Council approval of the final subdivision map. When said bonds and agreements have been filed with the City Clerk, the City Clerk secures the recordation of the map. However, if the subdivider does not provide said bonds and agreements within 60 days, the Council approval of the final map is void and it is necessary to resubmit the map to the City Council. In the case of the Bonita View Terrace Subdivision, the subdivider, because of current money market conditions, has been unable to secure full financing for the project and has, therefore, not filed the necessary bonds and agreement within the 60 day period. It is, therefore, now necessary for the Council to reapprove under the same terms and conditions, a subdivision map which will allow an additional 60 day period for submittal of the bonds and agree- ments. All previous required steps have been validly undertaken and, hopefully, the subdivider will be able to obtain financing within the next 60 days. It should be noted that the reason for allowing a 60 day period is that frequently the subdivider is unable to secure financing until ATTACHED: Resolution [ Financial Statement: N/A Commission-Board Recommendation: N/A Department Head Recommendation Ordinance [ ] Agreement [ ] Plat [ ] See EXHIBITS [X] No. 1 Approval of Resolution City Manager Recommendation: Concur with Department Heads ~~~~ l~enda Item No. 10 Suppl.emc:iital Wage 2 the City Counci.J_ has actc,d upon its final. subdivision map and, therefore, it is reasonable to obtain a resolution of approval. which the subdivider can to}:e to financial iri~titutions.
