THIS AGREEb:ENT, made and entered into this day of
19 , by and between THE CITY~OF CtIULA VISTA, a
municipal corporation, hereinafter referred to as "City", and ROHR
CORPORATION, a California corporation, hereinafter referred to as
"Property Owner";
W I T N E S S E T H
WHEREAS, Rohr Corporation has heretofore applied to the
Planning Commission of the City of Chula Vista for an exception to
the provisions of Chapter 27 of the Chula Vista City Code requiring
the installation of certain street improvements upon any dedicated
street or streets adjacent to the lot or parcel upon which a building
or structure is to be erected, which building or struc~ure has a valua-
tion of $S,OOG.00 or more, and
WHEREAS, in accordance with the provisions of said Chapter 27,
the Planning Commission, on March 17, 1969, approved the deferral of
standard required public improvements, _as requested by Property Owner,
Rohr Corporation, on the following streets:
"G" Street from West Bay Boulevard to Coronado Branch
Railroad;
"H" Street from b9est Bay Boulevard to Coronado Branch
Railroad; and
West Bay Boulevard, between "G" Street and "H" Street,
and
WHEREAS, said deferral was conditioned upon the posting of
a bond in the amount of $5,000.00 to secure the completion of said
improvements.
NOW, THEREFORE, it is mutually agreed by and between the
parties hereto as follows:
1. That Property Owner, Rohr Corporation, in lieu of making
the improvements specified herein, prior to the final inspection of
completion or the giving of any completion certificate, agrees, covenants
and promises that it will install, construct or cause to be installed
or constructed the improvements hereinafter set forth within thirty (30)
days of written notice to construct from the Planning Commission. Said
improvements shall be made without cost or expense to the City, except
as may be consented to by the City.
2. That to secure the faithful performance of the installa-
tion of said improvements, Rohr Corporation, concurrent with the execu-
tion of this agreement, shall deposite an improvement security in the
amount of $5,000.00 with the City of Chula Vista.
3. The public improvements shall consist of that work
specifically deferred by the action of the Planning Commission of the
City of Chula Vista, as follows:
