~2iiS~~i:U I~r~ NC! ~ 4663 Resolution Consenting to Consolidation of Sweetwater Junior College District Maximum Tax Rate Election with General Municipal Election to be held in the City of Chula Vista On motior. of Counc ilman Anderson , seconded by Councilman McCorquodale , the following resolution is adopted: WHEREAS, on April g, 1868, the General Municipal Election will be held in the City of Chula Vista; and WHEREAS, pursuant to the Charter of the City of Chula Vista, Article XII, at each general municipal election there is held within the territory of Chula Vista City School District an election of either three or two members of the Board of Education of Chula Vista City School District, as the case may be, to fill vacancies on said board as provided in the Charter; and WHEREAS, the Governing Board of Sweetwater Junior College District has ordered that a maximum tax rate election be held within the boundaries of the ST~reetwater Junior College District on the same day as the general municipal election os" the City of Chula Vista; and WHEREAS, the territory of the City of Chula Vista and of Chula Vista City School District is in part the same as the territory of Sweetwater Junior~College District; and WHEREAS, the Governing Board of Sweetwater Junior College District has requested this City Council to give its written approval of consent to the consolidation, within the territory of the Sweetwater Junior College District which is contained within the City of Chula Vista and within the Chula Vista City School District except that portion of Chula Vista City School District which lies within the boundaries of the City of National City, of the Sweetwater Junior College District maximum tax rate election with the General Municipal Election of the City of Chula Vista to be held on Tuesday, April g, 1868; and WHEREAS, it is desirable and in the public interest that said elections be consolidated; NO`~1 THEREFORE IT IS RESOLVED that pursuant to the provisions of Section 20803, and Sections 1333-1338, inclusive, of the Education Code, and Chapter 4 [commencing at Section 23300] of Part 2, of Division 12, of the Elections Code, this Council of the City of Chula Vista hereby approves and consents to the consolidation of .the Sweetwater Junior College District maximum tax rate election with the General Municipal Election of the City of Chula Vista to be held on Tuesday, April g, 1868. .. , IT IS FURTHER RESOLVED that pursuant to Section 23307 of the Elections Code (a) the election shall be held in all respects as if there were only one election; (b) only one form of ballot shall be used; (c) the returns of the maximum tax rate election within the territory of the City of Chula Vista and of Chula Vista City School District, except that portion of Chula Vista City School District which lies within the boundaries of the City of National City, will be canvassed by the City Council of the City of Chula Vista, or by such other officer as is empowered by said Council to canvass the returns of its election, as part of the canvass of the returns of its General Municipal Election; and (d) the returns of said maximum tax rate election within the territory affected by the order or orders of consolidation shall be certified by such canvassing body or officer to the County Superintendent of Schools. IT IS FURTHER RESOLVED that pursuant to Education Code Section 1335 and Elections Code Section 23305 within the territory affected by the order or orders of consolidation the election precincts, polling places, voting booths, and polling hours, shall, in every case, be the same and there shall be only one set of election officers in each of the precincts. IT IS FURTHER RESOLVED AND ORDERED that the City Clerk is hereby directed to deliver a certified copy of this resolu- tion to (1) the Governing Board of Sweetti~rater Junior College District, (2) the Superintendent of Schools of the County of San Diego, and (3) the Registrar of Voters of the County of San Diego.
