HomeMy WebLinkAboutReso 1968-4650.~; RESOLUTION N0. 4650 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA OPPOSING H.R. BILL 12142, TITLE VIII, SECTION 801, AND URGING THE MODIFICATION OF SAID BILL The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the City Board of Appeals, by Resolution No. 13, adopted on December 11, 1967, has recommended that the City Council oppose H.R. Bill 12142, Title VIII, Section 801, for the following reasons: 1. H.R. 12142 would reduce the building and housing code requirements for low cost housing, thereby creating potential slum areas and endangering the public welfare; 2. H.R. 12142 would make the Section of. Housing and Urban Development a one-person code writing body; 3. If H.R. 12142 is passed, cities would be required within three years to adopt these lesser housing requirements or they would not be eligible for any of the Federal subsidy, aid or assistance pro- grams including F.H.A. insured mortgages. This is complete federal control of local construction; 4. H.R. 12142 is not needed and this was evidenced in a recent HUD demonstration project which reported that substantial savings are not necessarily made by removing the present building code restrictions, and the present code requirements for fire resistance of apartment buildings are not excessive;, and WHEREAS, the City Council, having reviewed the recommendations of the City Board of Appeals and examined H.R. 12142, concurs in the opposition to said bill as presently written, and feels that the attempt to develop a building code appropriate to the needs of all the variable local communities throughout the United States is both totally impractical and unwarranted intrusion into a matter which is the subject of local regulatory devices. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby oppose H.R. Bill 12142, Title VIII, Section 801, and urges the appropriate modification of said bill. BE IT FURTHER RESOLVED that the City Clerk of the City of Chula Vista be, and he is hereby directed to forward certified copies of this resolution to the Honorable Senator Thomas Kuchel, the Honorable Senator George Murphy, the Honorable Congressman Lionel Van Deerlin, the Honor- able Congressman Bob Wilson.
