RESOLUTION NO o 4617
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA
APPROVING AGREEMENT BETWEEN 'THE CITY OF CHULA VISTA AND
JAMES R. LIBBY & ASSOCIATES, CONSULTING ENGINEERS, FOR THE PREPARATION
OF PLANS FOR BRIDGE AT FOURTH AVENUE, SOUTH OF "L" STREET IN SAID CITY
AND AUTHORIZTNG THE MAYOR TO EXECUTE SAME
The City Council of the City of Chula Vista does hereby
resolve as follows:
That that certain agreement between the City of Chula Vista,
a municipal corporation, and JAMES R. LIBBY & ASSOCIATES, Consulting
Engineers, for the preparation of plans for bridge at Fourth Avenue,
south of "L" Street
dated the 5th day of December 1967 , a copy of which
is attached hereto and incorporated herein, the same as though fully
set forth herein be, and the same is hereby approved.
BE .IT FURTHER RESOLVED that the Mayor of the City of Chula
Vista be, and he is hereby authorized and directed to execute said
agreement for and on behalf of said City

AGREEMEiJT FOR PREPARATION OF PLANS FOR BRIDGE
AT FOURTH AVENUE, SOUTH OF "L11 STREET
THIS AGREEMENT, made and entered into this 5th day of
December 1967, by and between THE CITY OF CHULA VISTA, a
municipal corporation, hereinafter called "City" and JAMES R. LIBBY
& ASSOCIATES, Engineers, a California Corporation, hereinafter called
"Engineer °' ;

WHEREAS, City desires to employ Engineer for preparation of
plans and specifications for the construction of a new bridge at Fourth
Avenue south of "L1° Street in the City of Chula Vista, and
WHEREAS, Engineer is willing to prepare said specifications.
NOW', THEREFORE, IT IS MUTUALLY AGREED by and between the
parties hereto as follows:
1. Engineer agrees to provide the following services:
a. Attend conferences with the City to review its wishes
and requirements; inspection of the site; review of
available material assembled by City; and discussion of
scheduling. Conferences also may be meld with various
approving and regulatory agencies, and with those utility
companies affected;
b. Assist in planning for and assisting the City in
procuring the necessary reconnaissance surveys and other
field investigations;
c. Preparation of preliminary engineering studies and
designs, to be submitted for review and approval by City
and other required approving agencies;
d. Preparation of preliminary layouts, sketches, outline
specifications and reports, where applicable, and the
Engineer's specific recommendations;
e. Preparation of preliminary cost estimates of the
project.
f. Preparation of detailed contract drawings in ink on
linen or in pencil on tracing paper; providing City with
mylar duplicate.
g. Preparation of specifications, contract documents,
and estimates;
h. Furnish City with twelve (12) copies of the completed
drawings, specifications, and other contract documents
for final review by City and approving authorities;
i. Assistance to City in securing bids, tabulations and
analysis of bid results, and furnishing recom~-nendations
on the award of construction contracts;
j. Consultation and advice to City during construction;
k. Preparation of elementary sketches and supplementary
sketches required to resolve actual field conditions en-
countered;
1. Checking detailed construction drawings and shop and
erection drawings submitted by the contractor for com-
pliance with the design concept;
m. Reviewing laboratory, shop and mill test reports of
materials;
n. Making periodic observations of work in progress, and
providing appropriate reports to City;
o. Making a final inspection and report of the completed
project, with City or its representative.
2. City agrees to provide Engineer with the following:
a. Detailed topographic rnaps of the construction site
extending not less than 300 feet upstream and 300 feet
downstream from the proposed bridge.
b. Detailed information pertaining to the location of
existing or proposed utilities within the limits of the
proposed construction.
c. Complete profile and alignment for Fourth Avenue in
the vicinity of the project.
3. City further agrees to provide for full-time inspection
during construction.
4. City agrees to pay Engineer as compensation for his
services a fee equal to 10% of the project construction cost. Payment
shall be made as follows:
a. 'Twenty-five percent (25%) of the estimated total
fee upon submittal of the preliminary design drawings.
b. Eighty percent (80%) of the estimated total fee
upon submittal of the contract drawings, specifications,
and documents.
c. Ninety percent (90%) of the total fee upon award of
the contract.
d. One hundred percent (100%) of the total fee upon
completion and. acceptance of the work by City.
IN WITNESS WHEREOF the parties hereto have caused this agree-
ment to be executed the day and the year first hereinabove set forth.
