RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA
APPROVING AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND
WINDSOR PARK ENTERPRISES, INC., FOR THE INSTALLATION OF
SLOPE PLANTING AND IRRIGATION SYSTEMS IIQ WINDSOR PART:
SUBDIVISIONS
AND AUTHORIZING THE MAYOR TO EXECUTE SAME
The City Council of the City of Chula Vista does hereby
resolve as follows:
That that certain agreement between the City of Chula Vista,
a municipal corporation, and Windsor Park Enterprises, Inc.
dated the 28th day of

is attached hereto and incorporated herein, the same as though fully
set forth herein be, and the same is hereby approved.

AGREEMENT TO INSTALL SLOPE PLANTING
AND AN IRRIGATION SYSTEM, AND PROVIDING
FOR THE MAINTENANCE THEREOF, ON SLOPES
ON LOTS 51 THROUGH 62 AND FOR LOT 50
' OF WINDSOR PARK SUBDIVISION
THIS AGREEMENT, made and entered into this 2~th day of November
1967, by and between THE CITY OF CHULA VISTA, a municipal corporation, here-
inafter called "City" and WINDSOR PARK ENTERPRISES, INC., a corporation,
hereinafter called "Subdivider";
W I T N E S S E T H
WHEREAS, City has heretofore approved a tentative map for that
certain subdivision known as WINDSOR PARK SUBDIVISION, and
WHEREAS, as a condition of the approval of said tentative map,
Subdivider has agreed to landscape the slopes, being portions of Lots 51
through 62 of said subdivision, and to landscape Lot 50 of said subdivision,
all_.in accordance with plans and specifications approved by the Director of
Planning of the City of Chula Vista, and
WHEREAS, Subdivider has further agreed to install an appropriate
irrigation and sprinkler system on said lots in accordance with plans and
specifications as approved by the Director of Planning, and to provide for
the maintenance of said landscaping for the periods set forth herein, and
WHEREAS, Subdivider is about to present a final subdivision map
for said subdivision known as WINDSOR PARK SUBDIVISION to the City Council of
the City of Chula Vista, for approval.
NOW, THEREFORE, IT IS MUTUALLY AGREED by and between the parties
hereto as follows:
• 1. Subdivider, WINDSOR PARK ENTERPRISES, INC., does hereby agree
to install planting and landscaping and an irrigation system on those slopes
being a part of Lots 51 through 62, and on Lot 50, of that certain subdivision
known as WINDSOR PARK SUBDIVISION, all in accordance with plans and specifications
as approved by the Director of Planning, within one (1) year of the date of
execution of this agreement.
2. Subdivider agrees that said areas shall be graded and planted,
including ground cover, shrubs and trees, in accordance with said specifications
on file in the Planning Department, with the types of plants and materials as
approved by the Director of Planning.
3. Subdivider agrees that each lot shall be supplied with an in-
dividual sprinkler system for slope watering, the type and location of such
systems to be approved by the Director of Planning.
4. Subdivider agrees to maintain said slope planting on Lots 51
through 62 for a period of at least one (1) year from the date of the completion
and acceptance of the landscaping and planting, or until the City accepts all
improvements within the Subdivision, whichever is later in time. Said main-
tenance shall include watering, fertilizing, weeding, dead plant replacement,
and litter removal.
5. Subdivider agrees that the landscaping and planting on Lot 50
shall be maintained by its owner for a period of five (5) years from the date
of the completion and acceptance of the landscaping and planting, or until usch
earlier date as determined by the Director of Planning when conditions have
changed which would eliminate the necessity for such maintenance. A separate
sprinkler-irrigation system shall be provided for this parcel.

6. Subdivider agrees to submit, subsequent to the execution
of this agreement and prior to the recordation of the final map of said
subdivision known as WINDSOR PARK SUBDIVISION, bonds in the following amounts
to insure the performance of the terms of this agreement.
a. Lots 51 through 62 of Windsor Park Subdivision - a bond
in the amount of $10,964.00 to insure the faithful performance
of the planting and installation of the sprinkler-irrigation
system on said lots.
b. Lot 50 of Windsor Park Subdivision - a bond in the amount
of $5,861.00 to insure the faithful performance of the plant-
ing and installation of the sprinkler-irrigation system on
said lot.
c. Lots 51 through 62 of Windsor Park Subdivision - a bond
in the amount of $1,000.00 to insure the maintenance of said
planting for a period of one (1) year.
d. Lot 50 of Windsor Park Subdivision - a bond in the amount
of $2,500.00 to insure the maintenance of said planting for
a period of five (5) years.
The terms and conditions of said bonds shall be that the City may make demand
upon the surety for such amounts as may be necessary at any time during the
prescribed period to insure the faithful performance of the terms and conditions
of this contract.
IN WITNESS WHEREOF, the parties hereto have set their hands the
day and year first hereinabove set forth.
