HomeMy WebLinkAboutReso 1967-4525Form No~ 342 RESOLUTION N0. 4525 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING AGREEMENT BETWEEN THE CITY OF' CHULA VISTA AND ROHR CORPORATION FOR THE LEASE OF CERTAIN CITY-OWNED PROPERTY AT THE FOOT OF "G" STREET KNOWN AS THE "G" STREET PARKING LOT AND AUTHORIZING THE MAYOR TO EXECUTE SAME The City Council of the City of Chula Vista does hereby resolve as follows: That that certain agreement between the City of Chula Vista, a municipal corporation, and Rohr Corporation, a California corporation, for the lease of certain city-owned property at the foot of "G" Street known as the "G" Street Parking Lot, dated the 15th day of August 1967 a copy of which is attached hereto and incorporated herein, the same as though fully set forth herein be, and the same is hereby approved. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute said agreement for and on behalf of said City. Presented by Fred A. CA:`PFFLL, City Clerk of t'.;e City of Chula 7iata, Cali: r,.-:_ia i "~ i!'nF15P" C?',uT-FY that the above and foregoing is a full, true and correc*_ coo-~ 01' and that the same ha; not be--~ 2:,~r:dad or r-o:~?led. 1~dT~ T' Cite Cie r:. cc-ss2 ysa5 PERMIT AGREEMENT FOR THE TEMPORARY USE OF CITY-OWNED PROPERTY BY ROHR CORPORATION THIS AGREEMENT, made and entered into this 15 tr day of August, 1967, by and between the CITY OF CHULA VISTA, a municipal corporation, hereinafter called "Permittor", and ROHR CORPORATION, a California corporation, hereinafter called "Permittee"; W I T N E S S E T H WHEREAS, Rohr Corporation desires to use certain City-owned property located on "G" Street adjacent to the West side of the Animal Shelter and immediately north of Rohr Corporation plant, to store large Antenna sub-assemblies prior to and in preparation for shipment to various off-site locations, and WHEREAS, the City of Chula Vista is willing to authorize the use of said property, as shown on the attached plat for said .purposes for a period of ninety (90) days. NOW, THEREFORE, IT IS MUTUALLY AGREED by and between the parties hereto as follows: 1. Permittor hereby authorizes Permittee to use that certain property adjacent to the west side of the Animal Shelter on "G" Street immediately north of Rohr Corporation plant, as shown on the attached plat, for a period of ninety (90) days, commencing August 15, 1967, for the purpose of storing large Antenna sub-assemblies prior to and in preparation for shipment to various off-site locations and for such supporting services as may be required to prepare the units for ship- - ment, including building and repairing skids, steel strapping, etc. ` 2. The term of this permit shall be from August 15, 1967 to November 14, 1967, for the total rent of THREE HUNDRED DOLLARS ($300.00) which Permittee agrees to pay to Permittor in the Office of the Finance Officer of the City of Chula Vista at the commencement of said agreement. 3. Permittee shall not use, or permit said premises or any portion thereof to be used for any purpose or purposes other than those set forth in this agreement. 4. Permittee shall make any reasonable repairs to the paved surface of the parking lot deemed necessary by the City Engineer as the result of said use by Permittee. 5. City, Permittor, its agents, officers and employees, shall not be, nor be held liable, for any claims, liabilities, penalties, fines or for any damage to the goods, properties or effects of Permittee, or any of its representatives, agents, employees, guests, licensees, invitees, patrons or clientele or any other persons whatsoever, nor for personal injuries to, or deaths of them, or any of them, whether caused by or resulting from any acts or omission of Permittee in or about the leased premises, or any act or omission of any person or from any defect in any part of the leased premises or from any other cause or reason whatsoever. Permittee further agrees to indemnify and save free and harmless City and its authorized agents, officers, and employees against any of the foregoing liabilities and any costs and expenses incurred by City on account of any claim or claims therefor. -1- `YJ`- 6. Any holding over, after the expiration of the term of this permit and with the consent of Permittor, shall be construed to be a permit from month t0 month at a rental Of ONE HUNDRED DOLLARS ($100.00) per month, and shall otherwise be on the terms a^.d conditions specified herein as applicable. IN WITNESS WHEREOF, this permit agreement is executed by the CITY OF CHULA VISTA, acting by and through its Mayor, and by ROHR CORPORATION, the day and year first hereinabove written.
