HomeMy WebLinkAboutReso 1967-4510Form No. 342 RESOLUTION N0. 4510 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND THE SPRING VALLEY SANITATION DISTRICT PROVIDING FOR THE IMPOSITION AND COLLECTION OF A SEWER CONNECTION FEE AND AUTHORIZING THE MAYOR TO EXECUTE SAME The City Council of the City of Chula Vista does hereby resolve as follows: That that certain agreement between the City of Chula Vista, a municipal corporation, and the Spring Valley Sanitation District, a county sanitation district, providing for the imposition and col- lection of a connection fee for Edgemere Avenue Sewer Line, dated the 25th day of July , 1967 a copy of which is attached hereto and incorporated herein, the same as though fully set forth herein be, and the same is hereby approved. AGREEMENT BETWEEN THE CITY OF CHULA VISTA--AND THE SPRING VALLEY SANITATION DISTRICT PRO- VIDING FOR THE IMPOSITION AND COLLECTION OF A CONNECTION FEE FOR EDGEMERE AVENUE SEWER LINE f~ ~, THIS AGREEMENT, made and entered into this .~/ ~ day of Le'+_r:LZ~~ 1967, by and between the CITY OF CHiTLA VISTA, a munic/ipal corporation, sometimes hereinafter called "Chula Vista," and the SPRING VALLEY SANITATION DISTRICT, a county sanitation district, sometimes hereinafter called the "District," W I T N E S S E T H: WHEREAS, on the 9th day of March, 1864, the City of San Diegc, the City of Chula Vista and the Spring Valley Sanitation District executed that certain agreement entitled "AGREEMENT BETWEEN THE CITY OF CHULA VISTA, THE CITY OF SAN DIEGO AND THE SPRING VALLEY SANITATION DISTRICT OF THE COUNTY OF SAN DIEGO FOR THE USE OF DISTRICT'S OUTFACE SEWER" (County of San Diego Contract No. 2624-2125-R) wherein provision was made for the discharge by Chula ~Iista into the Spring Valley Sanitation District's outfall sewer line for transportation to aid discharge into the San Diego Metropolitan Sewerage System sewage originating within an area within Chula Vista and therein designated as the area to be served; and WHEREAS, that certain sewer line was constructed by the District with District funds in Edgemere Avenue, a County highway, which lies on the boundary between the unincorporated i2-45tc territory of the County of San Diego and the City of Chula Vista as more specifically delineated and depicted on Exhibit A attached hereto; and WHEREAS, certain properties on the Chula Vista side of said sewer line were not assessed for the cost of construction and installation of such sewer line and some of the owners of said properties now desire to connect to and discharge into said sewer line sewage originating on their properties; and WHEREAS, the parties hereto deem it appropriate that such. properties fronting on Edgemere Avenue and said sewer line be permitted to connect thereto subject to the payment of a connection fee to be imposed and collected by Chula Vista for and on behalf of the District for reimbursement purposes for each connection of a sewer lateral line to such sewer line; NOW THEREFORE THE PARTIES HERETO AGREE as follows; Section 1. Upon the prior payment in full of the connection fees specified in Section 2 hereof, those certain properties within the City of Chula Vista fronting on Edgemere Avenue shall be allowed to connect to and be served by that certain sewer line constructed and owned by the District located in said Edgemere Avenue as more particularly delineated and depicted on Exhibit A hereto attached and incorporated herein. Section 2. Chula Vista shall impose and collect on behalf of the District a connection fee of $9.10 for each benefited front foot for each direct connection to that certain sewer line -2- ~-~{Sl0 constructed by the District in Edgemere Avenue on the boundary of the City of Chula Vista as delineated and depicted on that certain map. marked Exhibit A, attached hereto and incorporated herein, for which the properties were not assessed for the cost of construction thereof. Said fee shall be collected by Chula Vista from each applicant at the time application for a connection is made. The applicant shall then obtain all permits and pay all other fees or charges required by the District and the District shall then con- struct and install the sewer service lateral line in accordance with its engineering and design requirements. Chula Vista shall not permit or allow any connections to said sewer line other than as herein provided for. Chula Vista shall keep complete and accurate accounts and records as to all such connection fees so collected and shall submit such fees to the District within sixty (60) days following collection. Section 3. Upon paying the connection fees provided for in Section 2, and connecting to the sewer line located in Edgemere Avenue as depicted on Exhibit A hereto,. the properties so con- nected shall be subject to payment of all the fees and charges and be subject to all the terms and conditions provided for in that certain agreement executed by the parties hereto on March g, 1864, and entitled "AGREEMENT BETWEEN THE CITY OF CHULA VISTA, THE CITY OF SAN DIEGO AND THE SPRING VALLEY SANITATION DISTRICT OF THE COUNTY OF SAN DIEGO FOR THE USE OF DISTRICT°S OUTFACE SEWER" (County Contract No. 2624-2125-R) and Chula Vista shall assure that -3- 2-u 51© all such terms and conditions are fully and completely adhered to.
