Home My WebLink AboutReso 1970-5663RESOLUTION NO. 5663 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, EXTENDING THAT CERTAIN AGREEMENT BY AND BETWEEN THE CITY OF CHULA VISTA AND MAHY CONSTRUCTION COMPANY FOR THE IMPROVEMENT OF TELEGRAPH CANYON ROAD BETWEEN INTERSTATE 805 AND OLEANDER AVENUE The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, by Resolution No. 5291, adopted on the 15th day of July, 1969, the City Council approved that certain agreement by and between the City and Mahy Construction Company for the improve- ment of Telegraph Canyon Road between Interstate 805 and Oleander Avenue, which agreement is due to expire on July 15, 1970, and WHEREAS, Mahy Construction Company, by letter dated May 19, 1970, has requested an extension of time for the completion of said agreement, due to the fact that construction of said improvements has been delayed because additional grading and earth moving was required on the property adjacent to the proposed improvements, and further requested that a surety bond be substituted for the cash deposit required by said agreement, and WHEREAS, the Director of Public Works has reviewed said request, and recommends that said extension be granted. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that the completion time set forth in that certain agreement dated July 15, 1969 for the improvement of Telegraph Canyon Road be, and the same is hereby extended to and until the 15th day of July, 1971, and that a surety bond from the Fireman's Fund Insurance Company be accepted in lieu of the cash deposit required by said agreement.
