HomeMy WebLinkAboutReso 1970-5634RESOLUTION NO. 5634 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, WAIVING REQUIREMENTS FOR INSTALLATION OF SIDEWALK ALONG THE WEST SIDE OF FIRST AVENUE, SOUTH OF QUINTARD STREET, ADJACENT TO THE PROPOSED PALACE GARDEN MOBILE HOME PARK The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, Section 27.504 of the Chula Vista City Code requires that every person erecting, constructing, enlarging, altering, repairing, improving, converting or relocating any building or structure in the City of Chula Vista shall install public improvements prior to the com- pletion of such building or structure, in accordance with standards and specifications adopted by the City Council, and WHEREAS, Mr. Roy Muraoka, owner of the property south of Quintard Street and west of First Avenue, has heretofore submitted plans for developing this property into a mobile home park, and has requested that the requirement for the construction of a sidewalk along the west side of First Avenue based on the following reasons: 1. The additional dedication of 7.5 feet of right-of-way and construction of sidewalk would cause a hardship for the owner of an existing single family residence structure located at the southwest corner of Quintard Street and First Avenue. 2. The sidewalk is not needed on the west side of First Avenue because there will be no access from the proposed mobile home park to First Avenue and the mobile home park is the only development west of First Avenue, and WHEREAS, the Director of Public Works has reviewed said plans and request for waiver, and recommends that the City Council approve the waiver of the requirement for sidewalks along the west side of First Avenue, subject to the following conditions: 1. A 2-1/2 foot utility easement shall be granted by the owner, Mr. Roy Muraoka, to be situated at the ultimate location, as per standard drawing lOlA. the City. 2. Owner shall dedicate an additional 1 foot right-of-way to 3. Owner shall grant vehicular access rights to the City. 4. Owner shall be required to provide and install ornamental street light standards and fixtures in the type and number as approved by the Director of Public Works. Owner will also grant the necessary easements for the installation of street lights. NOW, THEREFORE, BE IT RESOLVED that the City Council, pursuant to the provisions of Section 27.506 of the City Code, does hereby waive the requirement for the construction of sidewalk along the west side of First Avenue, south of Quintard Street, subject to the conditions set forth hereinabove.
