RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA OPPOSING THE INCLUSION OF THE OTAY MUNICIPAL
WATER DISTRICT IN THE METROPOLITAN SEWERAGE SYSTEM
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the City of Chula Vista has been notified that the
City of San Diego, which manages and operates the Metropolitan Sewerage
System, proposes to enter into an agreement with the Otay Municipal
Water District, which water district would be designated as a "Later
Participating Agency" in accordance with the terms of the Joint Powers
Agreement establishing the Metropolitan Sewerage System, and
WHEREAS, the City of Chula Vista, pursuant to said agreement,
has the option of filing a written objection admitting any "Later Par-
ticipating Agency", and
WHEREAS, the City of Chula Vista strongly objects to the inclu-
sion of any special district in the Metropolitan Sewerage System, and
WHEREAS, the whole thrust of changing governmental organization
in the State of California has been the elimination of the multiplicity
of special districts and the extension of jurisdiction of general law
cities, and
WHEREAS, this proposed admission of the Otay Municipal Water
District is in direct opposition to the goal of all leaders in the State
of California since it will clearly tend to perpetuate the concept of
special districts providing limited services to the residents of the
unincorporated areas of the State, and
WHEREAS, the City of Chula Vista opposes the inclusion of
the Otay Municipal Water District in the Metropolitan Sewerage System
for the following additional reasons:
1. The City of Chula Vista has reserved capacity in the
Metropolitan System far in excess of the projected needs of the present
land area of the City. The excess reserve capacity is intended to serve
an area contemplated as the area of natural growth for the City. This
area was determined primarily upon the basis of the topography of the
land. This sphere of influence in matters of Metropolitan System capacity
reservation has been recognized by the Administration of the City of San
Diego as well as the Board of the Spring Valley Sanitation District.
The proposed agreement does not specify the area to be served
within the extensive limits of the Otay Municipal Water District. That
District encompasses most of the area for which the City of Chula Vista
is now purchasing capacity rights. Therefore, there exists a distinct
possibility that the District will utilize the proposed capacity right
to provide service to properties within the Chula Vista sphere of influence.
Such action would deprive the City of Chula Vista the reimbursement to
which it is entitled.
2. The basic plan for the Metropolitan System as prepared by
Holmes & Narver-Montgomery depicted a Metropolitan sewer service area
containing approximately 410 square miles. Such service area is shown

and discussed on pages 14 and 15 of the condensation of the "Basic Plan
for the Collection, Treatment and Disposal of Sewage for the Metropolitan
Area, San Diego, California."
The service area of the Otay Municipal Water District extends
as much as four miles beyond the Metropolitan service area as depicted
in the Basic Plan.
The Metropolitan System was tailored to meet the projected
needs of a specific area. The effect of sale of capacity rights to an
agency whose service area extends substantially beyond the Metropolitan
service area is at best obscure. No such sale should be permitted unless
it can be clearly demonstrated by detailed study that the extra demand
can be absorbed by the system as a whole as well as in relationship to
those components directly affected. A study of the type and scope as
proposed should be reviewed and approved by the Advisory Board of the
Metropolitan Sewerage System.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Chula Vista on behalf of themselves and all interested citizens
of this community who have long supported, through sewer service charges,
the development of the Metropolitan Sewerage System, that the admission
of the Otay Municipal Water District into the Metropolitan Sewerage
System be, and the same is hereby strongly opposed.
BE IT FURTHER RESOLVED that the City Clerk be, and he is
hereby authorized and directed to file a certified copy of this resolution
containing the objection to the inclusion in the Metropolitan Sewerage
System of the Otay Municipal Water District with the City Clerk of the
City of San Diego and forward certified copies of this resolution to
Mayor Frank Curran and each member of the City Council of the City of
San Diego, City Manager Walter Hahn, and City Attorney John Witt.
BE IT FURTHER RESOLVED that the City Clerk be, and he is
hereby authorized and directed to forward a certified copy of this reso-
lution to Senator James Mills, Assemblyman Wadie Deddeh and other members
of the San Diego County Legislative Delegation urging their support of
legislation which would terminate the ability of special districts
including water districts from expanding the service which they provide
and which more properly could be provided by the municipalities.
BE IT FURTHER RESOLVED that the City Clerk be, and he is
hereby authorized and directed to forward a certified copy of the reso-
lution to Supervisor Henry Boney and the members of the Board of Super-
visors of San Diego County urging said body to take all necessary steps
to support the opposition to the inclusion of the Otay Municipal Water
District in the Metropolitan Sewerage System.
