RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA, WAIVING BIDDING REQUIREMENTS AND APPROVING
CHANGE ORDER NO. 1 FOR THE CONSTRUCTION OF A SEWER
MAIN IN LOMA LANE
The City Council of the City of Chula Vista does hereby resolve
as follows:
WHEREAS, the City has heretofore entered into an agreement with
T. B. Penick & Sons for the construction of certain street improvements
in Loma Lane to serve Loma Verde Park, which improvements include the
construction of a sewer main in said street, and
WHEREAS, it has now been determined that the capacity of cer-
tain existing sewer lines will shortly be exceeded, and that the Max
Avenue Lift Station constructed in 1963 should, in the near future, be
replaced and a total gravity line to the south be constructed, a portion
of which is located in Loma Lane, which would necessitate that said
sewer line in Loma Lane be lowered at its northerly terminus eight (8)
feet, that two manholes be lowered, and that the sewer laterals be
lowered also, and
WHEREAS, the contractor presently engaged in the construction
of said improvements in Loma Lane has offered to perform said services
in conjunction with the construction of said street improvements for
an additional cost of $3,528.65, and
WHEREAS, it is recommended that the provisions of Section 1109
of the City Charter requiring formal advertising for bids be waived,
because it is of urgent necessity to perform said work at this time,
and that it is in the interest of the preservation of life, health and
property to do so.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Chula Vista that the formal advertising requirements of Section 1109
of the City Charter be, and the same are hereby waived, based upon said
recommendation and the findings of the City Council that said work is
deemed to be of urgent necessity for the preservation of life, health
and property.
BE IT FURTHER RESOLVED that the Mayor be, and he is hereby
authorized to execute said change order with T. P. Penick & Sons for
an additional amount of $3,528.65, to deepen the construction of the
sewer line and two manholes in Loma Lane.
BE IT FURTHER RESOLVED that the sum of $3,528.65 be, and the
same is hereby appropriated from the unappropriated surplus of the
Sewer Income Fund for the purposes hereinabove set forth.
