CHULA VISTA CITY COUNCIL MEETING OF: August 28, 1973
Resolution - Taking a position on AB 1144 which allows cities to adopt an
ITEM TITLE: ordinance requiring the dedication of land, the Construction of School
facilities, the payment of in lieu fees, or a combination of these
three devices as a condition of approval of a final subdivision map or
parcel map

A. BACKGROUND
AB 1144 has been recently amended to permit and authorize cities to adopt an
ordinance requiring developers to dedicate land for school sites, construct facilities,
pay in lieu fees, or a combination of the three. The bill's philosophy and provisions
are similar to those of the Quimby Act for park land dedication.
B. ANALYSIS
This bill, if passed, will be of great assistance to cities and school districts
alike in providing necessary school facilities, and would transfer the financial
responsibility for new facilities to new residents, who create the need. The finan-
cial responsibility of operating the schools (salaries, maintenance costs) would
still be on a district-wide basis.
The City of Chula Vista is already pursuing this matter under existing General Plan
policies but most other cities and counties in the State have not responded to the
problem to the same extent.
