Home My WebLink AboutAgenda Statement 1973/08/21 Item 05 CHULA VISTA CITY COUNCIL MEETING OF ITEM TITLE INITIATED BY: unrxr.Rnirnrn August 21, 1973 AGENDA ITEM NO ' [ 5 ] Resolution - Approving Agreement Covering Participation by the City of Chula Vista and the State in Construction of the South Leg of the Westerly Connection between the Route 5/54 Inter- change and Tidelands Avenue Director of Public Works/City Engineer The City of Chula Vista, National City and the Unified Port District have agreed in principle to participate in the connection of Route I-5/54 inter- change with Tidelands Avenue. The City Council, by Resolution 5940, instructed the staff to proceed with steps necessary to implement the con- struction of a connecting roadway between Tidelands Avenue and Route I-5/54 interchange. The City has already entered into an agreement with the State to accomplish the work of right of way acquisition and utility relocation required to construct said work. The Division of Highways has now prepared an agreemen covering participation by the City of Chula Vista and the State in con- struction of the south leg of the westerly connection between the Route 5/54 interchange and Tidelands Avenue. The agreement is now ready for Council consideration and approval.. It provides for the following: 1. State to include construction of these improvements in its con- templated freeway construction. 2. State to prepare plans and specifications for said improvements. 3. State to submit plans for the proposed improvements to City for review and approval prior to advertisement of State's construction project. 4. City to bear its share of the cost for preliminary engineering and construction engineering, including all direct and indirect charges, at a fixed rate of 8a and loo respectively of the construction cost for its share of the project. 6. The City's final share of the construction cost shall be determined by using the actual quantities computed on completion of State's contract including supplemental work and any additional or unforeseen work. attributable to City's share of the project. It is estimated that City's share of cost, including preliminary and con- struction engineering is $531,000. 7. City to deposit with State, City's estimated share of cost for the construction, preliminary and construction engineering, and indirect charges. Said share shall be deposited with State in three payments as follows: (a) Within thirty days after award of State's contract, and upon demand therefor, the sum of $200,000, said sum to be the first of three payments. (b) Within 180 days after award of State's contract and upon demand therefor,, the sum of $200,000, said sum to be the second of three payments. (c) Within 365 days after award of State's contract, and upon demand therefor, the sum of $131,000, said sum to be the third of three payments, In the event the actual cost is less than said deposit, State will refund the difference between the actual cost and the amount of the deposit by City. In the event the actual cost exceeds said deposit, City will pay the difference between the amount of said deposit and the actual cost of City's share. 8. This agreement will not be effective or binding until similar agreements are executed between the State Division of Highways and the Unified Port District and the City of National City. 9. The obligations of State under terms of this agreement are subject to the allocation of funds by the California Highway Commission. The City Council is requested to approve this agreement and to authorize the Mayor to execute the agreement on behalf of the City. Please refer to your letter dated October 18, 1972, in which you request that certain changes be made in the Agreement. We have made the changes that you suggested. In addition to the above-mentioned changes, we have made several minor changes in the Agreement and updated Exhibit "A" which shows an increase from $512,100.00 to $531,000.00. If the Agreement meets with your approval, please have it executed and return the original and two copies with a copy of the authorizing resolution attached to each. After the Agreement has been executed by the State, a duplicate original and as many conformed copies as you request will be furnished for your files. Please call us if you have any questions.
