[ 12 ) CHULA VISTA CITY COUNCIL MEETING OF: April 24, 1973 ITEM TITLE: Resolution - Opposing AB 14 Pertaining to Joint Powers Agreements INITIATED BY: City Manager Rorur.RnttNn On January 9, 1973, ABl4 was introduced into the California Legislature. This proposal would prohibit local agencies (i.e., Chula Vista) from entering into contracts or agreements with a joint powers entity (i.e., CPO) for: (a) the rental or lease of facilities being financed by joint powers revenue bonds, or, (b) the purpose of incurring any debt or obligation, until approved by two-thirds of the voters of such local agencies. At present, passage of the above Act would not have any significant impact upon our relationship with the Comprehensive Planning Organization. CPO has no bonded indebtedness nor do its member agencies have any legal obligation to financially support this kind of operation. However, it is questionable whether San Diego County cities should be restricted from modifying their associations due to the provisions of AB14. As sovereign entities they should be allowed the maximum freedom of action consistent with responsible government. Finally, it seems as though A B14 is taking a step backward when one considers the basic concepts of representative government and responsive action. City councils are elected to voice and implement the desires of their constituents. Time consuming, expensive plebiscites, such as those stipulated by A B14, diminish the reason-for-being of city councils and hamper their effectiveness. City Manager Recommendation: Accept report and recommendation of City Manager ~~~~ ~ AGENDA ITEM N0.[127 PAGE N0. 2 continued - Conclusions and Recommendations It has been concluded that A B14 would place unreasonable restrictions upon the financing prerogatives of local agencies and their joint powers entities. If this bill becomes law, it could seriously hamper the flexibility and responsiveness currently enjoyed by bodies such as the Comprehensive Planning Organization.
