HomeMy WebLinkAboutReso 1970-5756RESOLUTION N0. 5756 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA MODIFYING A CONDITION IMPOSED UPON THE APPROVAL OF THE TENTATIVE MAP OF CHULA VISTA GARDENS, UNIT NO. 6 The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the tentative map of Units Nos. 6 and 7 of that certain subdivision designated as Chula Vista Gardens has heretofore been approved by Resolution No. 5669 adopted by the City Council of the City of Chula Vista on the 26th day of May, 1970, and WHEREAS, one of the conditions of the approval of said tentative map was a requirement for off-site improvement of the north side of East Palomar Street, west of Unit No. 6, extending to 'Nolan Avenue, and WHEREAS, the developer of said subdivision requested that said condition be waived because said property was not in their own- ership and could not be acquired through negotiation, and WHEREAS, the Planning and Engineering staff agree that suf- ficient access exists through the development of the south side of East Palomar Street, and WHEREAS, the City Planning Commission on July 20, 1970, after consideration of this matter, determined that said condition should be waived and forwarded said recommendation to the City Council, and WHEREAS, the City Council, having considered said request for modification, has determined that said request is reasonable subject to the condition that the developer be required to construct a minimum amount of off-site construction in accordance with plans and specifi- cations on file in the office of the City Engineer thus eliminating the narrow neck existing at East Palomar Street and Nolan Avenue. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that the condition requiring off-site improvement of the north side of East Palomar Street, west of Chula Vista Gardens Unit No. 6 extending to Nolan Avenue be, and the same is hereby waived provided, however, that the developer shall be required to construct a minimum amount of o.ff-site construction in accordance with plans and specifica- tions on file in the office of the City Engineer thus eliminating the narrow neck existing at East Palomar Street and Nolan Avenue. Yt tqt Exv t~ 3ir<~~Sx ..'.w.ai t~"t4i:ittE: i~~~R ~t3i~'~it et City o~ CfnuQa ~U~sta CALIFORNIA July 21, 1970 The Honorable Mayor and City Council of the City of Chula Vista Civic Center Chula Vista, California Subject: PCS-7o-6 Chula Vista Gardens, Unit #6 - Modification of condition of approval Gentlemen: At the meeting held July 20, 1970, the City Planning Commission considered a request for a modification of a condition of approval for this sub- division which was a requirement for off-site improvement of the north side of East Palomar Street, west of Unit #6, extending to Nolan Avenue. The subdividers claim that the property in question is not in their ownership, and further, that they have been unable to acquire this property. Both the Planning and Engineering staffs are in agreement that the south side of East Palomar with existing improvements can service this pro- posed subdivision as additional access can be gained through Nacion Avenue connecting to the north and south.
