HomeMy WebLinkAboutReso 1970-5737 RESOLUTION NO. 5737 RESOLUTION OF THE CITY COUPdCIL OF THE CITY OF CHULA VISTA ADOPTING THE AREA STUDY FOR A PORTION OF "E" STREET AS RECOMMENDED BY THE CITY PLANNING COMMISSION The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the Planning Commission, subsequent to its hearing on June 15, 1970, forwarded to the City Council of the City of Chula Vista Resolution No. PCM-70-15 recommending the adoption of an Area Study undertaken for a portion of "E" Street between Del Mar and Guava Avenues, and WHEREAS, the City Council of the City of Chula Vista has held a public hearing on Tuesday, July 21, 1970 wherein testimony was received relative to said Area Study and policies to be followed in the application of specific zoning as requested within the study area, and WHEREAS, the City Council approved the recommendations of the Planning Commission. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista as follows: 1. From facts presented to the City Council and based on the recommendation of the Planning Commission, the City Council finds that public necessity, convenience, general welfare and good zoning practice require the adoption of the following policy in regard to the "E" Street Area Study: Leave the study area zoned C-T and a statement of policy be adopted that expansion of this C-T zone both to the north and south is recognized as neces- sary and desirable under certain conditions, and further, that the merits of such rezoning will be considered on an individual basis with any approval subject to approval by the Planning Commission of a Precise Plan. 2. The findings of fact in support of said determination are as follows: a. Based on the analysis of the study area, the area seems to be a rather typical thoroughfare commercial shopping area, even though several of the existing uses possess more restrictive characteristics. "E" Street is a major thoroughfare and does not have the pedestrian oriented shopping center atmosphere that Third Avenue or a shopping center possess. b. If commercial uses are going to be permitted to remain on this street, they must be permitted to expand as necessary to accommodate increased business, offstreet parking and modern development standards. This can be done only when a Precise Plan reveals that the location of buildings, walls, landscaping, etc., will permit the preservation of adjacent residential areas. 3. The City Council finds that in expansion of the existing commercially zoned properties within the study area shall therefor be accomplished and effective only upon submission and approval of a Precise Plan for the development of the area sought to b~ rezoned and incorporated into a total development with the frontage along "E" Street.
