RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA SUPPORTING SENATE BILLS 966 AND 967 PROVIDING
FOR THE TERMINATION OF UNPRODUCTIVE OIL LEASES
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, Senator Deukmejian has introduced at the request
of certain California cities Senate Bills 966 and 967 which provides
for the termination of unproductive oil leases, and
WHEREAS, said leases if allowed to continue in existence
under present circumstances will detrimentally affect the sound and
proper growth of several cities in the State of California, and
WHEREAS, in the interests of restoring prime land to its
highest and best use in said sister cities, the City Council of the
City of Chula Vista strongly urges support of these measures.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Chula Vista on behalf of themselves and in the interests of
mutual support for local governments, does hereby urge that the
Senate Committee on the Judiciary recommend that said bills do pass
and that said bills be approved by the State Legislature.
BE IT FURTHER RESOLVED that the City Clerk of the City of
Chula Vista be, and he is hereby authorized and directed to forward
copies of this resolution to the following members of the Senate
Committee on the Judiciary: Gordon Cologne (Chairman), Nicholas
Petris (Vice-Chairman), Anthony Beilenson, Clark L. Bradley, William E.
Coombs, George E. Danielson, George Deukmejian, Donald L. Grunsky,
Robert J. Lagomarsino, George R. Moscone, Lewis F. Sherman, Alfred H.
Song and Robert S. Stevens and also to members of the San Diego
County Legislative Delegation.

The City Council of the City of Signal Hi11 unanimously urges your
support for adoption of Senate Bills 966 and 967 (Deukmejian).
This legislation, being supported by the League of California Cities,
would provide for the termination of unproductive oil leases which
encumber the surface rights of land and prevent development, although
not producing oil in sufficient quantities to justify continuation of the
encumbrances. SB 967 defines in the absence of other specific defini-
tions or proof to the contrary, that production which is sufficient to
yield a reasonable rate of return to lessor and lessee, and provides
that in the absence of such production, the lease shall be deemed to
have terminated by its own provisions. SB 966 establishes a proced-
ure for either the lessor or lessee to bring an action to partition the
rights and interests of the lessor from those of the lessee. Preliminary
drafts of this legislation, prepared by the Ad Hoc Committee for the
Termination of Unproductive Oil Leases, are attached for your
consideration.
In asking your support of this important legislation, I would like to
submit the following information regarding the extent of the problem
of unproductive oil leases in the City of Signal Hi11. Within the City
limits are 595 acres of unoccupied land zoned primarily manufacturing
(M-1 and M-2) and apartment and highrise residential (R-4 and R-5).
In computing this vacant land, an area of 900 square feet was allowed

for marginally producing well sites now existing. The remaining land
dispersed between the well sites was then considered as vacant or
undeveloped.
This unoccupied land represents 4~. 3~% of the total City area. This
portion of our City which cannot be developed due to the present oil
lease restrictions is worth more than 66 million dollars based upon
current market value. Senate Bi11s 966 and 967 are based upon the
sound principle of developing land to its highest use. This is particularly
essential in this day and age when City government is under financial
strain, and must develop its land to the highest use in order to survive
economically. Therefore, as Mayor of the City of Signal Hill, I ask your
support in the adoption of Senate Bi11s 966 and 967. Even if your City
is not directly affected by the oil problem, I hope that you will support
this legislation on the principles of highest use of land and our mutual
interests in furthering good local government.
These bills are scheduled to be heard by the Senate Committee on the
Judiciary in the very near future. Members of this Committee are:

Thank you for your letter and resolution supporting
SB 966 and 967. You have waited very patiently for a reply,
and I appreciate your consideration.
As you know, SB 966 would have established a procedure
for severing the right of entry or occupation from a par-
cel of land encumbered by mining rights leases, including
community leases, which provided for the right of entry or
occupation. Senate Bill 967 would have established pre-
sumptions to determine the measure of the term of oil and
gas leases when certain important words or phrases were not
defined.
Neither of these bills reached the Assembly for a vote.
Therefore, they did not come before me for consideration and
did not become law. However, the author is studying the
situation and intends to introduce the bills again next year.
