Home My WebLink AboutReso 1970-5714RESOLUTION NO. 5714 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, APPROVING SUPPLEMENTAL AGREEMENT 11B" AND FIRST AMENDMENT TO THE MASTER AGREEMENT FOR TRAFFIC SIGNAL MAINTENANCE BETWEEN THE CITY OF CHULA VISTA AND THE COUNTY OF SAN DIEGO, AND AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO EXECUTE SAME The City Council of the City of Chula Vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED that that certain Supplemental Agreement "B" and First Amendment to the Master Agreement for Traffic Signal Maintenance between the City of Chula Vista and the County of San Diego dated the 2nd day of February, 1965, a copy of which is attached hereto and incorporated herein by reference be, and the same is hereby approved. BE IT FURTHER RESOLVED that the Director of Public Works of the City of Chula Vista be, and he is hereby authorized and directed to execute said agreement for and on behalf of said City. DATED City Clerk SUPPLEMENTAL AGREEMENT "B" AND FIRST AMENDMENT TO AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND THE COUNTY OF SAN DIEGO FOR THE MAINTENANCE OF TRAFFIC SIGNALS IN THE CITY OF CHULA VISTA THIS SUPPLEMENTAL AGREEMENT "B" and FIRST AMENDMENT, made and entered into this /~f"~ day of ~T~ 1~.: 1970, to that certain agreement by and between THE CITY OF CHULA VISTA and THE COUNTY OF SAN DIEGO, as approved by the Council by Resolution No. 3598 on the 2nd day of February, 1965; W I T N E S S E T H: WHEREAS, the parties to that certain agreement by and between THE CITY OF CHULA VISTA and THE COUNTY OF SAN DIEGO, made and entered into on the 2nd day of February, 1965, as approved by Resolution No. 3598, desire to amend said agreement by providing for an increase in Section II thereof, °'Costs and Charges", to provide for a monthly rate of Two Dollars and Forty Cents ($2.40) for routine maintenance per signal head, in lieu of the sum of Two Dollars and Thirty Cents ($2.30) as presently set forth in said agreement, and WHEREAS, in made for the adjustme tions covered by said the signals presently Street and Industrial Agreement. Section II of said agreement, provision is also nt of the number and/or location of signal installa- agreement, and the City now desires to include being installed at the intersection of Palomar Boulevard in said Master Signal Maintenance NOW, THEREFORE, IT I5 MUTUALLY AGREED by and between the parties hereto as follows: 1. That subsection A of Section II, "Costs and Charges" of said Master Signal Maintenance Agreement be, and the same is hereby amended to read as follows: II. COSTS AND CHARGES A. A flat monthly rate of Two. Dollars and Forty Cents ($2.40) per signal head shall be charged for routine maintenance. City may adjust said monthly maintenance charge annually at the beginning of each fiscal year. However, if City elects to adjust said charges, it shall give County thirty (30) days written notice in advance of the effective date of such adjustment. 2. That, pursuant to the authorization contained in Section III of said agreement, the following signals shall be included within the provisions of said Master Signal Maintenance Agreement: Palomar Street and Industrial Boulevard - County share 25~, City share 75%. Taylor County Engineer 5555 Overland Avenue San Diego, CA 92123 REVISED AGREE~~aENT FOR MAINTENANCE OF TRAFFIC SIGNALS BETWEEN CITY OF CHULA VISTA AND COUNTY OF SAN DIEGO Enclosed are three copies of Supplemental Agreement "B" and First Amendment to agreement between the City of CY~ula Vista and the County of San Diego for the maintenance of traffic signals in the City of Chula Vista. The agreement provides the first amendment to the basic maintenance agree- ment for the increase of costae and charges from $2.30 to $2.40 per month. It also provides for the supplemental agreement "E", adding Palomar Street and Industrial $oulevard signal installation and maintenance. The installation would be shared 25$ by the County and 758 by the City. If this agreement is in order, please execute on behalf of the County and return the original to this office. Since the change in the County organization, the title "County Surveyor and Raad Commissioner" shaven on the agreement is incorrect. Please change in accordance with your present operations. LANE F.
