ITEM TITLE: Resolution - Declaring Intention to Improve Alley from "H"
Street to Mankato Street and between Fourth Avenue
and Glover Avenue under the 1911 Improvement Act

On December 21, 1971, the Planning Commission approved a Conditional Use
Permit for Mr. Andrew Henry which required the improvement of a portion of
the alley behind his property located on the west side of Fourth Avenue
between "H" Street and Mankato Street.
Mr. Henry then requested the City Council to approve the initiation of
proceedings for a 1911 Act to improve the entire alley. After Mr. Henry
circulated a petition (which was signed by 49.03% of the property owners
of property within the proposed district), the City Council, on April 4,
1972, authorized the Director of Public Works to proceed with a 1911 Act
Improvement District.
On October 31, 1972, Council adopted Resolution 6643 accepting the 1911
Act petition (which was then signed by 62.79% of the property owners).
This resolution directed the City Engineer to prepare plans and specifi-
cations for this project. These plans and specifications have been
completed and a preliminary cost estimate has been prepared; therefore it
is requested that a resolution of intention be adopted by the City Council
to accomplish the following:
a. Direct that a public hearing be held on January 16, 1973.
b. Direct the City Clerk to have published in a local paper said
resolution, the time and place of the public hearing, and a plat of the
proposed assessment district. The notification should be published twice
with the first publication date being at least 10 days prior to the date
of the public hearing.
c. Direct the Superintendent of Streets to send the Notice of Improve-
ment to owners of property within the proposed assessment district of the
public hearing and to post said Notice of Improvement as prescribed.

Broadway to Smith Avenue and between "H" Street
and Otis Street under the 1911 Improvement Act

On April 4, 1972, the City Council directed the staff to take action to
complete improvements in the alley lying between "H" Street and Otis
Street, from Broadway to Smith Avenues. A 1911 Act petition was circulated
by property owners of the proposed improvement district. Owners of 70.6
of the property area within this proposed district signed the petition.
The petition was filed with the City Clerk.
On August 8, 1972, the City Council passed Resolution No. 6540 accepting
said petition and directing the City Engineer to prepare the necessary
plans and specifications for this project. The plans and specifications
have been completed and a preliminary cost estimate has been prepared;
therefore it is requested that a resolution of intention be adopted by
the City Council to accomplish the following:
a. Direct that a public hearing be held on January 16, 1973.
b. Direct the City Clerk to have published in a local paper said
resolution, the time and place of the public hearing, and a plat of the
proposed assessment district. The notification should be published twice

of the public hearing.

area to be assessed, the Council acquires jurisdiction to order the
proposed work to be done.

d. The resolution contains a description of the type bond for the

of the Improvement Act of 1911, Part 5, Division 7 of the Streets and
Highways Code.
