On April 6, 1965, the City Council approved Resolution 3668 endorsing the
Sweetwater River Flood Control Program as prepared by the Army Corps of
Engineers. This resolution declared the City's intent to enter into
negotiations prior to actual construction to determine a mutually equitable
apportionment of costs. The resolution further declared the City's intent
to reimburse the County for expenditures made for certain "betterments"
to streets, bridges, utilities and drainage structures beyond the responsi-
bility of the State or Federal agencies to reimburse.
In March of 1970, the Council approved an agreement between Chula Vista,
the County of San Diego and National City for payment of interest charges
for State funds advanced in behalf of local agencies.
The County staff has recently prepared another agreement to formalize the
City-County relationship in regard to the distribution of certain costs.
This formalization is in accord with the City's intent as expressed in
Resolution No. 3668.
The following is a summary of the principal provisions of this latest
agreement:
1 . The County wi 1 1 prepare plans and specificati ons , acquire right of
way, and relocate and reconstruct certain facilities not covered by
the existing Cooperative Agreement between the County and the Division
of Highways.
2. The County will bear nonreimbursable costs for right of way,
relocation, and reconstruction within unincorporated area of the
County.
3. The County will make all necessary negotiations and agreements
with the Federal Government for maintenance of the flood control
project.
4. The City will bear nonreimbursable costs for right of way, relo-
cation, and reconstruction within the City limits.

5. The City will pay to the County 30% of the cost of maintaining
the flood control project facilities. The City is to deposit its
estimated share of annual cost prior to July 15 of each year.
This project involves many agencies and requires numerous interagency
agreements because of its complexity and size. Agencies involved include:
City of Chula Vista
City of National City
County of San Diego
San Diego Unified Port District
State Division of Highways
State Department of Water Resources
U.S. Army Corps of Engineers
Precise cost responsibilities have not been determined in all aspects of
the project, nor have detailed plans been completed. For these reasons
it is not possible to ascertain the ultimate City cost at this time.
Discussions with the County, which agency is acting in behalf of the
local agencies, reveals that there is apparent general accord between
the County, the Division of Highways, and the Department of Water Resources
in regard to what "betterments" will result from the construction. Per
the agreement the final authority to fix nonreimbursable costs rests with
the Department of Water Resources. However, based upon the best available
information the City should anticipate the following nonreimbursable
expenses:
1. Right of way expenses within the City - - - - - None Now Known*
2. Relocation and reconstruction expenses within

3. Annual maintenance expense - - - - - - - - - - $9,000.00
*Related expenses beyond the project limits such as Edgemere Avenue
realignment, and the Tidelands Avenue to the I-5/54 interchange connecting
roadway are not included in Flood Control Project cost considerations.
The proposed agreement stipulates that the agreement shall not be binding
upon the City unless other related agreements essential to completion of
the project are duly executed by the County with National City, the
Unified Port District, and the Division of Highways.

San Diego County
The subject agreement is scheduled for Council
consideration on October 31, 1972. It is important
that we expedite the execution and return of two
copies to the County .
Please obtain Mayor Hamilton's signature and affix
a certified copy of the resolution of approval to
each copy of the agreement at your earliest con-
venience on November 1, 1972. Upon completion,
please notify Engineering for pick-up and further
processing.
