Backgr.nun~' :
On Febru~~_ry 13, 19b4, the City entered into an agreement with the Montgomery
Sanitation Dis'cr.ict, City of San Diego and County of San Diego which pro-
vided for_ the joint use of certain sewage facilities in an area generally
between "L'" Street and Main Street. The agreement in part prohibits the City:
from serving any lands outside the boundary of the service area specified in
the agreement.
From time to time the agreement has been amended to a11aw sewer service to
areas not included in the originally specified service area.
Thiere is now a need to provide for sewer service to an area north of Otay
Valley Road from just east of Oleander Avenue to the westerly boundary of
the Otay Rancho. 'phis area was annexed to the Ca_ty in 1971 and 1972 as
Brandywine Annexation and Otay Valley Road Annexation and has subsequently
been partially developed through subdivision activity. The terms of the
agreement make it necessary to approve an amendment to allow extension of
sewer service to the subject area.
Through the request of the Director of Public Works, the County Department
of Sanitation and Flood Control, acting as engineers and administrators for
the Montgomery Sanitation District, has prepared a seventh amendment to the
original agreement. The amendment has been reviewed by the Department of
Public Works.

Financial Fees of $70 per acre are to be collected from developers within

has been collected and will be forwarded to the district. IQo

SUBJECT: Seventh Amendment to Agreement Among the City of Chula
Vista, the City of San Diego, the Montgomery Sanitation
District and the County of San Diego for the Construction,
Operation and Use of Sewers.
At the request of your city, County Counsel has prepared and we are
enclosing eight (8) copies of subject agreement. This agreement
provides for the inclusion of two additional areas which have been
annexed by your city into Service Area III as defined in the basic
agreement.
If this agreement appears satisfactory, would you please present it
to your Council for execution. After your Council has executed the
agreement, please return all copies to this Department for further
processing.
