RESOLUTION NO. 6085
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA
APPROVING THAT CERTAIN MEMORANDUM OF UNDERSTANDING CON-
CERNII`dG WAGES AND OTHER TERMS AND CONDITIONS OF EMPLOYMENT
BETWEEN THE CITY OF CHULA VISTA AND THE CHULA VISTA
EMPLOYEES ASSOCIATION FOR FISCAL YEAR 1971-72
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the representatives of the City Manager of the City
of Chula Vista, acting for and on behalf of the City Council of the
City of Chula Vista, have heretofore met and conferred with the Chula
Vista Employees Association, an organization representing certain
members of classified employees in the City of Chula Vista, in accor-
dance with the provisions of Section 3500 et seq. of the Government
Code of the State of California, and
WHEREAS, the Memorandum of Understanding jointly prepared
by said parties as a result of meeting and conferring has been pre-
sented to the City Council and is contained in Exhibit "A", attached
hereto and incorporated herein by reference as if set forth in full.
NOW, THEREFORE, BE IT RESOLVED that the City Council of. the
City of_ Chula does hereby approve and accept said Memorandum of_ Under-
standing as contained in Exhibit "A" for fiscal year 1971-72.

MEMORANDUM OF UNDERSTANDING CONCERNING WAGES AND OTHER
TERMS AND CONDITIONS OF EMPLOYMENT BETWEEN THE CITY OF
CHULA VISTA AND THE CHULA VISTA EMPLOYEES ASSOCIATION
FOR FISCAL YEAR 1971-72
WHEREAS, the representatives of the City Manager of the City
of Chula Vista, acting for and on behalf of the City Council of the
City of Chula Vista, have heretofore met and conferred with the Chula
Vista Employees Association, an organization representing certain members
of classified employees in the City of Chula Vista, in accordance with
the provisions of Section 3500 et seq. of the Government Code of the
State of California.
WHEREAS, as a result of meeting and conferring in good faith
with said group, agreement has been reached on the following terms and
conditions of employment as applied to those classified employees who
are members of and represented by the Chula Vista Employees Association,
and said representatives of the City Manager and of the Chula Vista
Employees Association do now jointly prepare a written Memorandum of
Understanding concerning said agreed terms and conditions of employment
for presentation to the City Council of the City of Chula Vista for
determination, to-wit:
1. City hereby agrees to that certain salary understanding
for fiscal year 1971-72 as contained in Exhibit "A", attached hereto
and incorporated herein by reference as it set forth in full.
2. City hereby agrees to the following fringe benefits
proposal and changes in the Civil Service Rules as required:
(a) Protective clothing will be available for use to
employees in the following classifications when
working with hazardous materials:
Equipment Operator
Equipment Repairman
Senior Maintenance Main
Utility Man
Maintenance Man
Grounds-Maintenance Leadman
Groundsman-Gardener
(b) One hundred twenty (120) day maximum sick leave accumu-
lation be changed to provide for unlimited accumulation
of sick leave.
(c) Management will continue to work with the Employee
Association in establishing a training program which
will assist in the control of out-of-class assignments.
(d) Alter administration of vacation policy to provide for
the following:
1. Vacation will be accrued bi-weekly.
2. After one year of satisfactory service and upon sat-
isfactory completion of the probation period, vacation
may be used as accrued.
3. Employees who have more than the allowable vacation
time after adoption of this vacation provision shall
not suffer reduction of such time which is in excess
of Rule IX, Section 2(b), until one year from the
date of adoption of this provision.

(e) Modify Civil Service Rule II, Section 12, so that an
employee is paid 5o differential for a full work day
when working a majority of his shift after 5:00 p.m.
or before 8:00 a.m.
(f) Floating holidays may be taken when requested by the
employee with the approval of the Department Head.
Floating holidays may be added to vacation days and
they may be taken consecutively. If floating holidays
are not taken before the end of the fiscal year, they
will be lost to the employee.
(g) Modification of Civil Service Rule II, Section 5,
Part "A", to provide for pay increases on the anni-
versary date of hire or promotion.
(h) Retain Civil Service Rule II, Section 10, Part "B",
that the employee shall be paid time and one-half in
addition to what he would normally be paid for the
holiday.
(i) Management will continue to work with the Employee
Association in establishing a Grievance Procedure
as soon as possible.
3. It is further understood and agreed that any other benefits
and working conditions and the terms and conditions thereof presently in
effect shall remain unchanged (except for amendments to the Civil Service
Rules which liberalize employee benefits) unless and until said terms and
conditions shall be modified as a result of meeting and conferring in
good faith between the City and the Chula Vista Employees Association
pursuant to the provisions of Section 3500 of the Government Code of the
State of California, provided, further, however, that all terms and con-
ditions agreed upon by this Memorandum of Understanding shall remain in
full force and effect for the entire fiscal year 1971-72.
4. It is further understood and agreed that if and in the
event that the Legislature of the State of California adopts legislation
which becomes law at.any time during the fiscal year 1971-72 related to
and affecting any of the terms and conditions of employment agreed to
in this Memorandum of Understanding, that this Memorandum shall be void
and of no further force and effect and all terms and conditions herein
shall be subject to renegotiation.
