RESOLUTION NO. 6027
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF .CHULA VISTA
APPROVING THE TENTATIVE MAP OF A SUBDIVISION TO BE KNOWN
AS F.B.M. SUBDIVISION
The City Council of the City of Chula Vista' does hereby
resolve as follows:
WHEREAS, the Planning Commission' of' the City,'of Chula Vista
has heretofore approved that certain tentative map of' a subdivision to
be known as F.B.M. SUBDIVISION
and has recommended that the City Council approve said tentative map
subject to the conditions as recommended in their letter dated the
16th day of . March , 1971 , a copy of, which is attached
hereto and by. this reference made a.part-hereof, the same. as though
fully set forth herein.
NOW, THEREFORE, BE IT RESOLVED-by the City Council of the
City of Chula.Vista that said Council does hereby approve said tenta-.
tive subdivision map in 'accordance with the' recommendations of the
Planning Commission of the City of'Chula Vista.

Subject: PCS-71-2 - Tentative map for F.B.M.
At the meeting of March 15, 1971 the City Planning Commission
considered the tentative map of F.B.M., a two lot subdivision
between Fourth Avenue and Glover Avenue, 455 feet south of D
Street. This would permit the conversion of an existing
deve~opment with 46 units from a rental project to a condominium
under the provisions of the State Map Act.
The Commission recommends approval of the tentative map subject
to the following conditions:
1. The permittee shall make provisions as outlined below, to assure
the continued maintenance and operation of all open space and
improvements and obtain the City Planning Commission's approval of
such provision:
The permitee and all persons, firms or corporations owning the
property at the time of the recording of the final map and their
heirs, administrators, executors, successors and assigns shall
establish a Homeowners Association which shall have the duty to
operate, maintain and repair such open space, facilities and
improvements until such time as the operation and maintenance of
said recreational facilities and improvements is assumed by some
public agency, district, corporation or legal entity approved by
the City Planning Commission.
In lieu of said Homeowners Association or in combination therewith,
the permittee may request permission to establish an Open Space
Facilities and Improvement Maintenance District pursuant to the
ordinances of the City of Chula Vista, which district shall have

the power to assess the homeowners within the subdivision and
levy such assessment annually to be collected with the tax
bill by the County Assessor for such amounts as may be necessary
to perform said service by contract with a private maintenance
service corporation.
2. A copy of the deed restrictions shall be filed with the City.
These restrictions shall prohibit conversion of any parking stalls
or carports for any other use.
3. The terms and conditions of this subdivision shall be binding upon
the permittee, all persons, firms and corporations having an interest
in the property subject to this subdivision, and the heirs, executors,
administrators, successors and assigns of each of them, including
municipal corporation, public agencies and districts.
4. Sidewalks shall be constructed on Glover Avenue and ornamental
street lights shall be installed on Glover Avenue and Fourth Avenue
subject to the standards of the Engineering Division.
5. The developer shall sign an agreement with the City not to oppose
the formation of a district for the purpose of undergrounding utility
