RESOLUTION NO. 6199
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA OPPOSING AB 2622 PERTAINING TO REQUIREMENTS FOR
PLANNING AND ZONING HEARINGS
The City Council of the City of Chula Vista does hereby resolve
as follows:
WHEREAS, AB 2622 seeks to impose a requirement upon all cities
including charter cities of virtual "courtroom" formality upon the pro-
ceedings in zoning hearings, and
WHEREAS, such procedural rigidity is totally unacceptable in
proceedings before lay bodies who are not trained to act as administrative
officers and those who come before Planning Commissions and City Councils
on zoning matters are frequently not represented by attorneys and are
unfamiliar with the procedural rules set forth in AB 2622.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Chula Vista that AB 2622 should be defeated in the interests
of avoiding legalistic strictures which are both unwarranted and un-
necessary in zoning hearings and further said bill is vague and uncertain.
BE IT FURTHER RESOLVED that the City Clerk of the City of Chula
Vista be, and she is hereby authorized and directed to forward certified
copies of this resolution to Senator James Mills, Assemblyman Wadie P.
Deddeh and to all members of the San Diego County legislative delegation.

AB 2622 - Mr. Brathwaite's bill on State requirements for planning and
zoning hearings. This bill is counter to the recommendations
made by the city attorneys in the last revision of the plan-
. ning and zoning laws. This bill is too nebulous and causes
loss of flexibility.
Opposed RECO,'~1MENDATION: Opposition with letter to Mr. Deddeh and
M.r. Mills plus committee members.
AB 2294 - Mr. Quimby's bill having local control limited on mobilehomes.
Opposed, Mr. Lindberg stated that the City has already passed a resolu-
Resolution tion opposing this bill (R-6148, passed on 7/27/71).
AB 1098 - Mr. Z'berg's bill having mandatory retirement benefits for
policemen and firemen approved by the Assembly. This bill
would amend existing PERS contracts to provide for the re-
tirement of policemen and firemen at age 50 at 2$ of final
compensation per year of service and would lower the manda~ory
retirement age from. 65 to 60. It appropriates $10 million
each year to assist contracting agencies in meeting increased
costs. In the long run, the city will probably take over the
entire amount.
Opposed RECOMMENDATION: Opposition with letter to Mr. Deddeh and
Mr. Mills plus committee members.
AB 844 - Mr. Burton's bill regarding collective bargaining for public
employees. This bill guarantees public workers an opportunity
to seler_t a collective bargaining agent by.majority vote.
This committee would be opposed to the bill because it calls
for a Union tis basically a Union Shop). Mr. Scott stated we
do meet in good faith and have reached agreements with employees.
Opposed RECOMMENDATION: Opposition with letter to Mr. Deddeh and
Mr. Mills plus committee members.
SB 1083 - Mr. Marks' bill having cities required to provide free
bicycle parking'at a ratio of at least one bicycle space
for every 25 car spaces, but not less than 10 bicycle
spaces in each off-street parking facility.
The committee is opposed to this bill because of its "manda-
tory" aspects, as well as, why should bicycles be allowed to
park free. The committee thinks this skiould be the decision
of the City, not the State.
Opposed RECOMMENDATION: Opposition with letter to Mr. Deddeh and
Mr. Mills plus committee members.
AB 2116 - Mr. Ccry's bill regarding disclosure of assets by elected
officials and planning commissioners.
